Source of Funds本招標文件第二冊第六章投標資料表中所述的招標人已擁有一筆資金/貸款。TheTenderee named in the Volume II Section 6 Bid Data Sheet of the bidding documents has obtained a fund/loan.招標人計劃將一部分資金/貸款用于支付本次招標后所簽訂合同項下的款項。TheTenderee intends to apply a portion of the proceeds of this fund/loan to the payments under the

Tendering Agent and曰igible Bidders招標機構 2.1 Tendering Agent機電產品國際招標機構是指依照中華人民共和國商務部令2005年第6號機電產品國際招標機構資格審定辦法取得招標資格并從事機電產品國際招標代理業務的企業法人。TheTendering Agent for ICB Procurement of Mechanic and Electronic Products (hereinafter referred t

18、o as Tendering Agent) means the Legal Person approved and authorized by the Ministry of Commerce to handle the procurement of mechanic and electronic products by way of International Competitive Bidding (ICB) in accordance with the Measures for Examining and Approving the Qualification of Internatio

19、nal Tendering Institutions for Electromechanical Products, Decree No.6, 2005 of the Ministry of Commerce of the People s Republic of China.本次招標的招標機構名稱、地址、電話和傳真見投標資料表。Details such as name, address,telephone and facsimile of the Tendering Agent for this bidding are listed in the Bid Data Sheet.合格的投標人2

20、.2 Eligible Bidders1)投標人是響(不當用詞)標、參加投標競爭的法人或其他組織。除非另有規定，凡是來自中 華人民共和國或是與中華人民共和國有正常貿易往來的國家或地區(以下簡稱 含格來源國/地區”的供貨人均可投標。1) Bidders are legal persons or other organizations whoparticipate in bidding. This Invitation for Bids is open to all suppliers from within the Peoples Republic of China (hereinafter a

24、合同的支付也僅限于這些貨物和服務。3.1 All goods and related services to besupplied under the contract shall have their origin in eligible source countries/areas, as defined in clause 2.2 above, and all expenditures made under the contract will be limited to such goods and services.本款所述的 原產地”是指貨物開采、生長或生產或提供有關服務的來源地。所

Goods are produced when, through manufacturing, processing, or substanti

Compilation Principle and Content of Bidding Documents本招標文件的編制依據是中華人民共和國招標投標法和中華人民共和國商務部令2004年第13號機電產品國際招標投標實施辦法。5.1 The bidding document is compiledbased on The Bidding Law ofe People s RepubliOfna and Order N

29、o.13 2004 of the Ministry of Commerce “ The Measures for the Implementation of International Competitive Bidding of Mechanical and Electrical Products. ”要求提供的貨物、招標過程和合同條件在招標文件中均有說明。招標文件以中文或中、 英文兩種文字編寫。以中、英文兩種文字編寫時，兩種文字具有同等效力；中文本與英文本如有差異，以中文本為準。5.2 The goods required, bidding procedures and contract

30、terms areprescribed in the bidding documents. The bidding document is written either by Chinese or by Chinese and English. Failure to furnish all informationrequired by the bidding documents or to submit a bid not substantially responsive to the bidding documents in every respect will be at the Bidders risk and may result in th

Clarification of Bidding Documents任何要求對招標文件進行澄清的潛在投標人，均應以書面形式通知招標機構和招標人。 6.1 A prospective Bidder requiring any clarification of the bidding documents may notify the Tendering Agent and the Tenderee in writing.招標機構對其在投標資料表中所述投標截止期5日以前收到的對招標文件的澄清要求均以書面形式予以答復，同時將書面答復發

35、給每個購買招標文件的潛在投標人(答復中不包括問題的來源)。 The Tendering Agent will respond in writing to any request for clarification of the bidding documents which it receives no later than five (5) days prior to the deadline for the submission of bids prescribed in the Bid Data Sheet. Written copies of the Tendering Agents

36、response (without identifying the source of inquiry) will be sent to all prospective bidders who have purchased the bidding documents.投標人認為招標文件存在歧視性條款或不合理要求，應在規定時間內一次性全部提出。6.2 If the Bidder regards any discrimination clause or unreasonable requirement in thebidding document, he shall submit once and

38、ctive Bidder, may modify the bidding documents by amendment.招標文件的修改是招標文件的組成部分，將以書面形式通知所有購買招標文件的潛在投 標人，并對潛在投標人具有約束力。潛在投標人在收到上述通知后，應立即以書面形式向招標機構和招標人確認。7.2 All prospective bidders who have purchased the bidding documentswill be notified of the amendment in writing, and will be binding on them. The amen

39、dment is a part of the bidding document. Prospective Bidders shall promptly acknowledge the receipt thereof in writing to the Tendering Agent/the Tenderee.為使投標人準備投標時有充分時間對招標文件的修改部分進行研究，招標機構和招標人將適當推遲投標截止期。7.3 In order to afford prospective bidders reasonable time in which to take the amendment into a

41、and documents relating to the bid exchanged by the Bidder and the Tendering Agent/ the Tenderee, shall be written in the language specified in the Bid Data Sheet.投標人提交的支持資料和已印刷的文獻可以用另一種語言，但相應內容應附有投標資料表中規定語言的翻譯本，在解釋投標文件時以翻譯本為準。Supporting information and printedliterature furnished by the Bidder may b

47、riate Bid Schedule of Prices the unit prices (where applicable) and total bid price of the goods it proposes to supply under the contract.投標總價中不得包含招標文件要求以外的內容，否則，在評標時不予核減。The total bidprice shall not include any items beyond the requirement of the bidding document; otherwise, the offer on such items
