第九條合同的解除

（一）甲乙雙方應(yīng)主動(dòng)履行合同，未到租賃期限不得無故終止合同，否則應(yīng)按一年租金擔(dān)當(dāng)違約責(zé)任。

（二）有下列情形之一的，本合同終止，甲乙雙方互不擔(dān)當(dāng)違約責(zé)任：

1、該房屋因城市建設(shè)須要被依法列入房屋拆遷范圍的。

2、因地震、火災(zāi)等不行抗力致使房屋毀損、滅失或造成其他損失的。

（三）甲方有下列情形之一的，乙方有權(quán)單方解除合同且甲方退還保證金：

1、不擔(dān)當(dāng)約定的修理義務(wù)致使乙方無法正常運(yùn)用該房屋的。

2、交付的房屋危及乙方平安或者健康的。

（四）乙方有下列情形之一的，甲方有權(quán)單方解除合同，收回該房屋且保證金不退：
