11、ng"fourgood" lea dershi p constr ucti on泗陽縣城區(qū)房屋拆遷管理實施細則第一章總則第一條為加強對城區(qū)房屋拆遷的管理,維護拆遷當(dāng)事人的合法權(quán)益, 保障建設(shè)項目順利實施,根據(jù)國務(wù)院城市房屋拆遷管理條例、江蘇省城市房屋拆遷管理條例、宿遷市市區(qū)房屋拆遷管理實施辦法,結(jié)合本縣實際,制定本實施細則。第二條凡在縣城規(guī)劃區(qū)范圍內(nèi)國有土地上實施房屋拆遷,并需要對被拆遷人補償、安置的,適用本細則。規(guī)劃區(qū)內(nèi)房屋區(qū)位劃分為:一類區(qū):東至繁榮路、西至洋河路、南至大運河、北至長春路。二類區(qū):1城東部分:東至上海路、西至繁榮路、南至大運河、北至北京路;2城北部分:東

12、至繁榮路、西至洋河路、南至長春路、北至北京路;3城西部分:東至洋河路、西至泗水大道、南至大運河、北至北京路。三類區(qū):1城東部分:東至泗塘河、西至上海路、南至大運河、北至泗水大道向北 500 米;2 城北部分:東至上海路、西至泗水大道向西500 米、 南至北京路、北至泗水大道向北500 米;3城西部分:泗水大道向西500 米內(nèi),南至大運河;4 城南部分:東至上海路向東500 米內(nèi)、 西至泗水大道向西500 米、南至意楊大道向南500 米,北至大運河。四類區(qū):1城東部分:泗塘河以東至縣城規(guī)劃范圍;2城南部分:上海南路向東500米外至縣城規(guī)劃范圍、意楊大道向南 500 米外至縣城規(guī)劃范圍;3城北部分

13、:泗水大道向北500米外至縣城規(guī)劃范圍;4城西部分:泗水大道向西500米外至縣城規(guī)劃范圍。凡屬劃分區(qū)位分界道路的沿街戶,屬于二類區(qū)的提高為一類區(qū),三類區(qū)的提高為二類區(qū)。第三條城市房屋拆遷必須符合城市規(guī)劃,有利于城市舊區(qū)改造和生態(tài)環(huán)境改善,注重保護文物古跡和城市綠化。第四條本細則所稱拆遷人是指取得房屋拆遷許可證的單位。本細則所稱被拆遷人是指被拆遷房屋的所有人。本細則所稱房屋拆遷實施單位是指取得省建設(shè)行政主管部門核發(fā)房屋拆遷資質(zhì)證書,受拆遷人委托,從事對被拆遷人進行拆遷動員,落Wewillcontinue toimprovethe compa ny's inter nalcontrol s

24、議,組織拆除房屋及其附屬物工作的單位。第五條泗陽縣建設(shè)局(以下簡稱拆遷主管部門)主管本縣城市規(guī)劃區(qū)內(nèi)的房屋拆遷工作,具體負責(zé)全縣房屋拆遷管理工作。縣公安、司法、城管、國土、規(guī)劃、工商、稅務(wù)、信訪、供電、供水、物價等有關(guān)部門應(yīng)當(dāng)依照法定的工作職責(zé),并結(jié)合本細則規(guī)定,共同參與,互相配合,保證房屋拆遷管理工作的順利進行。泗陽縣國土局負責(zé)城市房屋拆遷有關(guān)的土地管理工作。第六條對依法批準的建設(shè)用地范圍內(nèi)的房屋拆遷,拆遷人應(yīng)當(dāng)依照本細則對被拆遷人給予補償和安置;被拆遷人應(yīng)當(dāng)服從城市建設(shè)需要,在規(guī)定的期限內(nèi)完成搬遷工作。各有關(guān)部門、單位和個人應(yīng)當(dāng)服從和配合房屋拆遷工作。第二章拆遷管理第七條凡因項目建設(shè)需要拆

25、遷房屋的,建設(shè)單位應(yīng)當(dāng)向拆遷主管部門提出申請,領(lǐng)取房屋拆遷調(diào)查通知書,辦理房屋拆遷許可證。(一) 拆遷人申請領(lǐng)取房屋拆遷調(diào)查通知書,應(yīng)向拆遷主管部門提交下列資料:1房屋拆遷調(diào)查申請書;2建設(shè)項目批準文件;3建設(shè)用地規(guī)劃許可證(附用地紅線圖);4國有土地批準文件。經(jīng)拆遷主管部門核準后,方可進行拆遷調(diào)查。(二)拆遷人申請領(lǐng)取房屋拆遷許可證,應(yīng)提交下列資料:1拆遷申請表(附拆遷補償明細表);2拆遷管理部門指定的辦理存款業(yè)務(wù)的金融機構(gòu)出具的足額、專用拆遷補償安置資金證明;3房屋拆遷委托評估合同;4委托拆遷實施合同。拆遷主管部門應(yīng)當(dāng)自收到申請之日起30 日內(nèi), 對申請項目進行審查。經(jīng)審查, 對符合條件的

26、拆遷人頒發(fā)房屋拆遷許可證。拆遷人領(lǐng)取房屋拆遷許可證后,方可實施拆遷。第八條拆遷人實施房屋拆遷的補償安置資金應(yīng)當(dāng)足額存入拆遷管理部門指定的辦理專項存款業(yè)務(wù)的金融機構(gòu),資金專項用于房屋拆遷的補償安置,不得挪作他用。第九條拆遷人可以委托拆遷,也可以自行拆遷。自行拆遷的,應(yīng)當(dāng)經(jīng)拆遷主管部門審批許可,且擁有 3 名以上經(jīng)市房屋拆遷行政主管部門專業(yè)培訓(xùn)和考核,取得房屋拆遷上崗證的拆遷工作人員,方可自行拆遷。委托拆遷的,應(yīng)向有拆遷資質(zhì)的被委托單位出具委托l(wèi)aylevels cadres in enterprisedevel opme ntin t he ofbackboneba ckboner ole;t

42、門在發(fā)放拆遷許可證的同時,應(yīng)當(dāng)將拆遷人、拆遷范圍、拆遷項目、拆遷時限、拆遷實施單位、評估機構(gòu)等以房屋拆遷公告的形式予以公布。拆遷人應(yīng)及時向被拆遷人發(fā)送房屋拆遷通知書, 并在拆遷現(xiàn)場公示房屋拆遷許可證、拆遷政策、拆遷補償標準、拆遷工作流程、拆遷實施單位和評估單位名稱等事項。拆遷范圍所在地的鄉(xiāng)鎮(zhèn)、場、社區(qū)及其居委會應(yīng)當(dāng)積極解決拆遷中出現(xiàn)的問題,做好宣傳解釋工作。第十一條拆遷人應(yīng)當(dāng)在房屋拆遷許可證和公告規(guī)定的拆遷范圍和拆遷期限內(nèi)實施房屋拆遷。需要延長拆遷期限的,拆遷人應(yīng)當(dāng)在拆遷期限屆滿15 日前,向拆遷主管部門提出延期拆遷申請;拆遷主管部門應(yīng)當(dāng)在收到延期拆遷申請之日起 10 日內(nèi)給予書面答復(fù)。第十二

43、條拆遷范圍確定后,拆遷范圍內(nèi)的單位和個人,不得進行下列活動:(一)新建、擴建、改建房屋;(二)改變房屋和土地用途;(三)租賃房屋。拆遷主管部門應(yīng)當(dāng)就前款所列事項,書面通知公安、工商、稅務(wù)、規(guī)劃、城管、房管、國土、供電、供水、電信等部門和單位以及有關(guān)鄉(xiāng)鎮(zhèn)人民政府、場、社區(qū)。有關(guān)部門和單位自接到書面通知之日起,停止辦理拆遷范圍內(nèi)的戶口遷入、分立, 工商營業(yè)執(zhí)照,房屋產(chǎn)權(quán)登記,房屋新建、翻建、擴建、改建、買賣、交換、出租等手續(xù)。書面通知應(yīng)載明暫停期限,暫停期限最長不超過一年。第十三條在房屋拆遷許可證規(guī)定期限內(nèi),拆遷人或受委托的實施單位應(yīng)與被拆遷人依照本細則簽訂書面拆遷補償安置協(xié)議。拆遷補償安置協(xié)議應(yīng)

44、載明補償方式、補償金額、付款方式、付款期限、搬遷期限、搬遷過渡方式、過渡期限、拆遷期限和違約責(zé)任等內(nèi)容。房屋拆遷協(xié)議匯總表須報拆遷管理部門備案,必要時, 應(yīng)經(jīng)公證機關(guān)公證。第十四條被拆遷人重新購買住房,其成交價沒有超出拆遷補償費和安置補助費的,免繳房屋買賣契稅,但超出部分應(yīng)繳納房屋買賣契稅。第十五條拆遷補償協(xié)議簽訂后,被拆遷人或房屋承租人在搬遷期限內(nèi)拒絕搬遷的,拆遷人可以向仲裁委員會申請仲裁,也可依法向人民法院起訴。訴訟期間,拆遷人可以依法申請人民法院先予執(zhí)行,laylevels cadresin enterprisedevelopme ntin the ofbackboneba ckbone

57、。拆遷人依照本細則已對被拆遷人給予貨幣補償或提供拆遷安置用房、周轉(zhuǎn)用房的,復(fù)議或訴訟期間不停止拆遷的執(zhí)行。第十七條被拆遷人或者房屋承租人在房屋拆遷主管部門裁決規(guī)定的搬遷期限內(nèi)未搬遷的,由縣人民政府責(zé)成拆遷主管部門及相關(guān)鄉(xiāng)鎮(zhèn)、 場組織強制拆遷,或者由拆遷主管部門依法申請人民法院強制執(zhí)行。實施強制拆遷前,拆遷人應(yīng)當(dāng)就被拆除房屋的有關(guān)事項,申請公證機關(guān)辦理證據(jù)保全公證。第十八條尚未完成拆遷補償安置的建設(shè)項目發(fā)生轉(zhuǎn)讓的,應(yīng)當(dāng)經(jīng)拆遷主管部門同意,原拆遷補償安置協(xié)議中有關(guān)權(quán)利、義務(wù)隨之轉(zhuǎn)移受讓人,項目轉(zhuǎn)讓人和受讓人應(yīng)當(dāng)自轉(zhuǎn)讓合同簽訂之日起30 日內(nèi)予以公告。第十九條房屋拆除應(yīng)當(dāng)由具備保證安全條件、持有省級

58、以上建設(shè)行政主管部門核發(fā)的建筑業(yè)企業(yè)資質(zhì)等級證書和安全資格證書的企業(yè)承擔(dān),施工人員應(yīng)經(jīng)培訓(xùn)并持有上崗證,并編制拆除方案,確保房屋拆除中的人身、財產(chǎn)安全。需要停水、停電或拆除有關(guān)管線的,由拆遷人在拆遷公告期滿后向有關(guān)部門申請辦理。施工企業(yè)負責(zé)拆除施工的安全工作。第二十條拆遷范圍內(nèi)的房屋拆除完畢,拆遷人應(yīng)當(dāng)報拆遷主管部門驗收。拆遷主管部門、拆遷實施單位應(yīng)當(dāng)建立健全檔案管理制度,加強對拆遷檔案資料的管理。第二十一條拆遷中涉及軍事設(shè)施、教堂、寺廟、文物古跡等,按照有關(guān)法律、法規(guī)的規(guī)定辦理。第三章拆遷補償與安置第二十二條拆遷人應(yīng)依照本細則的規(guī)定對被拆遷人給予補償。拆除違章建筑和超過批準期限的臨時建筑不予補償。超過拆遷期限仍未拆除的,由拆遷人申請城管部門依法拆除。拆除未超過批準期限的臨時建筑,按房屋有效剩余時間給予補償。住宅房屋以建設(shè)工程規(guī)劃許可證頒發(fā)之日起至拆遷許可證頒發(fā)之日止, 不滿 5 年被拆遷的,拆遷人應(yīng)當(dāng)對被拆遷人增加補償金額,增加補償?shù)臉藴拾幢徊疬w房屋的補償金額計算:未滿 5 年的增加15%,laylevels cadresin enterprisedevelopme ntin the ofbackboneba ckbonerole;t o fullstre n
