華泰財險附加賠款接受人條款（CB-H版）

當財產的權益相關方為債權人或抵押權人，保險人應：

●與被保險人核定損失金額；并且

●按相關權益的優先順位，向被保險人和權益相關方支付損失或損壞的賠款。

即使出現以下情形，權益相關方仍然有權獲得賠款：

●因被保險人未能遵守本保險條款，其理賠申請被保險人拒絕；或

●權益相關方啟動了拍賣或相似的程序

前提是該等權益相關方：

●在投保人未能按期支付保險費的情形下，按照保險人的要求支付該等保險費；

●按保險人的要求在60天內提交簽字確認的損失證明；

●將其知曉的任何所有權、占用性質的變更或任何風險的實質性變更通知保險人。

權益相關方可獲得賠償以以下金額的較低者為準：

●丟失或受損財產的實際現金價值；

●權益相關方在財產中享有的經濟利益；

●保險單對丟失或受損財產的責任限額。

若保險人向權益相關方賠償了任何損失或損壞，同時因被保險人的行為或被保險人未能遵守本保險條款拒絕向被保險人進行賠付，則：

●權益相關方的權益應轉讓給保險人，且應以保險人已經賠償的部分為限；且

●權益相關方收到賠償的權益不應受到影響。

本保單其他條件維持不變。

LossPayeeClause

Withrespecttopropertyinwhichinterestparty(ies)isalenderormortgagee,theInsurerwill:-

●Adjustlosseswiththeinsured;and

●Payanyclaimforlossordamagejointlytotheinsuredandtointerestparty(ies),inorderof

precedence,asinterestsmayappear.

Interestparty(ies)hastherighttoreceivelosspayment,eventhough:

●Thecompanydeniedtheinsured’sclaimbecausetheinsuredfailedtocomplywiththetermsofthisinsurance;or

●Interestparty(ies)startsforeclosureorsimilaractions,

Ifinterestparty(ies):

●PaysanypremiumdueattheInsurer’srequestiftheinsuredhasfailedtodoso;

●Submitsasigned,swornproofoflosswithin60daysoftheInsurer’srequest;and

●HasnotifiedtheInsurerofanychangeinownership,occupancyorsubstantialchangeinriskknowntointerestparty(ies)

Interestparty(ies)righttoreceivelosspaymentislimitedtothelesserofthefollowing:

●Theactualcashvalueofthelostordamagedproperty;

●Interestparty(ies)financialinterestintheproperty;

●Theapplicablelimitofinsuranceforthelostordamagedproperty

IftheInsurerpaysinterestparty(ies)foranylossordamageanddeniespaymenttotheinsuredbecauseoftheinsured’sactsorbecausetheinsuredhasfailedtocomplywiththetermsofthisinsurance,interestparty(ies)rights:

●WillbetransferredtotheInsurertotheextentoftheamounttheInsurerpaid;and

●Reco
