定義：

買賣合同是指一方當(dāng)事人向另一方轉(zhuǎn)移標(biāo)的物所有權(quán)，另一方當(dāng)事人支付價(jià)款的合同。在這一合同關(guān)系中，按照約定轉(zhuǎn)移標(biāo)的物所有權(quán)的一方為出賣人，接受所有權(quán)并支付價(jià)款的一方為買受人。

SalesContract定義：買賣合同是指一特征：

(l)買賣合同是轉(zhuǎn)移標(biāo)的物所有權(quán)的合同。當(dāng)事人實(shí)施買賣合同，賣方不僅要將標(biāo)的物交付給買方，而且要將所有權(quán)一并轉(zhuǎn)移。

(2)買賣合同是雙務(wù)合同。買賣合同的當(dāng)事人雙方都事有一定的權(quán)利，同時(shí)又負(fù)有相應(yīng)的義務(wù)。

(3)買賣合同是有償合同。買賣合同的有償性是指合同的任何一方當(dāng)事人的獲得都以自己的付出為代價(jià)。

(4)買賣合同是諾成合同。買賣合同的雙方當(dāng)事人就買賣事宜意思表示一致，合同即告成立，而不以標(biāo)的物的實(shí)際交付為成立條件。特征：
