Both parties adhere to releva nt provisi ons of the state and this muni cipality releva nt laws and regulati ons.一、聘用期限Employme nt Period第一條 期限為 年,自 年月日起至年月日止。This con tract will take effective from(date, mon th, year)

4、 to(date, mon th,year).二、工作內容及工作地點Work ing Content And Work ing Locati on第二條 甲方根據工作需要聘用乙方從事 工作。Party A employ Party B to work in area according to the need ofbus in ess.第三條乙方的工作地點為 。Party Bworking place is .第四條乙方應按所在崗位和工作內容的要求,認真履行職責,按時完成工作任務,遵守甲方依法制定的規章制度。Party B shall fulfill his working duties ac

5、cording to the requirement of the post and job content and finish the work in time. Party B should abide by the rules and regulations in Party A.第五條 根據工作需要,經雙方協商一致,甲方可以調整乙方的工作崗位、工作地點。If required by the work and with agreement by both parties, Party A can adjust Party Bs job title and work location.三

6、、工作時間和休息休假Worki ng Hours And Vacati ons第六條根據乙方工作崗位的實際情況,確定工作時間按以下第 種工時工種制執行。Accordi ng to the actual situati on of Party Bs job, opti onof the followi ng would bechose n to be the work ing times schedule.(一)標準工時工作制:每日工作不超過八小時,且甲方應保證乙方每周至少休息一天。Standard working hours: Work no more than eight hours a d

7、ay, and Party A shall ensure at least one off-day each week for Party B.(二)不定時工作制:甲方在保障乙方身體健康并充分聽取乙方意見的基礎上,應采用集中休息、輪休調休、彈性工作時間等適當方式,確保乙方的休息休假權利和生產工作任務完成。Non-fixed worki ng hours: With con siderati on for Party B health con diti on and suggestio ns, Party A would adopt a proper way including concentr

8、ated rest, paid leave, flexible working hours to en sure Party Bs right on rest and vacati ons with completi on of Party Bwork.(三)其他類型的作息時間: Other types of working hours : 四、勞動報酬Payme nt第七條 乙方的薪酬標準為:每月支付乙方工資 元(稅前)。Party Bs sta ndard salary is:RMB per month (before tax).第八條甲方每月日前以銀行劃賬形式支付乙方工資。Party A

9、 would pay Party B before every of the month through bank transfer.第九條甲方依法從乙方工資中代扣代繳乙方應向國家繳納的個人所得稅及法定可代扣代繳的其他費用。Party A would withhold Party B due pers onal in come tax and other legally charged fees from Party B salary.五、勞動保護、勞動條件和職業危害防護Labor Protect ion. Work ing Con diti ons And Occupati onal Haz

10、ard Protect ion第十條甲方根據乙方崗位的實際情況,向乙方提供符合國家規定標準的勞動保護用品。Accord ing to the actual situatio n of Party B job requireme nt. Party A shall provide labor protection articles qualified for provisions of the state standard.第十一條甲方為乙方提供符合國家安全衛生標準的工作場所和完成工作任務所必須的勞動工具。Party A should provide work places qualified

11、for national safety and health sta ndards and tools n ecessary for the job.第十二條甲方根據國家有關法律法規,建立健全安全生產制度和職業危害防護制度,雙方應當嚴格遵守,嚴禁違章作業,防止事故的發生,減少職業危害。Party A shall establish safe producti on system and occupati onal hazards protecti on system accord ing to releva nt state laws and regulati ons. Both partie

12、s shall strictly abide by it to avoid illegal operatio n and preve nt accide nts which may cause occupati onal hazards.第十三條乙方對甲方管理人員違章指揮、強令冒險作業,有權拒絕執行;對危害生命安全和身體健康的勞動條件,有權提出批評、檢舉和控告。Party B is entitled to decline any violated order or forcing of risk duties. Party B has the right to criticize, impea

13、ch and charge to any labor conditions which may endan ger his/her life safety and body health.六、勞動紀律Labor Discipli ne第十四條 遵守國家法律、法規及甲方指定的各項規章制度,遵守職業道德,維護甲方的榮譽和利益,按時保質保量地完成工作任務是乙方應盡的義務。Party B shall comply with n ati on al laws, regulatio ns and rules poin ted by Part A, abide by professional ethics,

14、 protect the honors and interests of Party A and ensure his/her completed staff work.第十五條乙方應遵守甲方根據生產經營需要依法指定的規章制度和勞動紀律。如乙方違反 甲方指定的規章制度和勞動紀律,甲方有權根據規章制度進行處理。Party B should abide by the specified rules, regulations and labor discipline specified by Party A accordi ng to the n eeds of bus in ess operati

Party A has the right to proceed with rules and regulations if there are violations to the rules, regulations and labor discipli ne from Party B.第十六條甲方的各類規章制度,及甲乙雙方簽訂的有關協議均為本合同的有效補充,與本合同具有同等的法律效力。All rules and regulatio ns, in clud ing agreeme nts sig ned by Party A and Party B aside from this

16、con tract, have the equal legal effect as this con tract.七、合同的履行、變更、解除、終止、續訂Impleme nt, Chan ge, Remove, End and Renew Of The Con tract第十七條 聘用合同期滿前一個月,經雙方協商同意,可以續訂聘用合同。Agreed by both parties, Party A and Party B can sig n a renew con tract a month before the expiry date of the con tract.第十八條下列情形之一本合

17、同可終止Follow ing situatio ns may cause con tract term in ati on(一)本合同期滿The con tract expires(二)雙方就解除本合同協商達成一致Both parties agree on term in ati on of the con tract(三)簽訂合同時的客觀條件發生變化,無法繼續履行合同The objective con diti ons cha nges and the con tract cannot con ti nue to perform(四)乙方由于健康原因不能繼續履行本合同義務的Due to Pa

18、rty Bs health problems, he/she cannot continue to perform the obligations of this con tract(五)其他情況:Other con diti ons:第十九條甲、乙雙方若單方面解除本合同,可提前三十天以書面形式告知對方即可。To termi nate this con tract from a sin gle party, he/she n eeds to inform the other party in writte n form 30 days in adva nee.第二十條本合同終止、解除后,乙方應

19、在30天內將有關事項及因履行本協議從甲方處取得的資料文件等向甲方移交完畢,并附書面說明;移交完畢后公司將在下一工資發放日結算并發放剩余報酬;如未履行相關交接工作并給甲方造成損失,應予賠償。Once remove or expirati on of the con tract, Party B shall return releva nt matters including documents and information obtained from Party A within 30 days with written statement. Any losses caused by in capable of complete tran sfer would be asked for compe nsati on toParty A.八、特別約定及其它事項Other Matters第二十一條 乙方變更通信地址或手機、固定電話等其它聯系方式時,應當于變更發生之日 起十日內書面通知甲方。If Party B changes communication address or other contact inform

21、ation, such as the cell number and fixed telephone, he/she shall give a written notice to Party A within ten days from the changes.第二十二條 本合同未盡事宜,雙方可以協商簽訂補充協議,補充協議與本合同具有同等效力。For items not mentioned in this contract, both parties can negotiate to sign a supplementary agreement. Supplementary agreement

22、 enjoys same legal effect as this contract.第二十三條 本合同自甲、乙雙方蓋章或簽字之日起生效。本合同一式兩份,甲乙雙方各執一份。This contract is effective by signatures of both parties. This contract is made in duplicate and each party holds one counterpart.第二十四條 甲方的員工手冊和規章制度為本合同附件。Handbook and other rules and regulations legally stipulated

23、 by Party A are annexes of this contract.甲方(蓋章) :甲方(蓋章) :Party A (stamp):Party B (signature):法定代表人或主要負責人 (簽字蓋章)補充協議The notice of termination must be submitted in writing. 有關終止合同的通知必須以書面形式提交。A revocation of the appointment of Mr / Ms GF for development ladder can be carried out by the shareholders me

24、eting for important reasons at any time. Important reasons particularly gross breach of duty or incompetence are to be considered for proper management. Possibly resulting compensation claims by the development manager of this Agreement shall not be affected by the revocation. 提交重要原因并經股東會通過,可以隨時廢除該合

25、同。重要原因應包括失職或不能勝任該職位。研 發中心總經理若提出補償索賠要求,將不受到合同廢除影響。HR:合同的解除及補償中國是有相關法律規定的,如出現以上情況依據中國法律規定執行。不建議合同中約定The con tractual relati on ship ends without no tice at the end of the month in which his head of development 65/66/67. Years of age (depending on age development manager).合同將在研發中心總經理 年滿 65/66/67 歲(依據研發

26、中心總經理年紀而定)的當月末自動失效。HR:因Manfred年齡達到中國法律規定退休年齡,因此不存在退休等問題。可通過合同約定期限或相關解除條款等方式解除合同 不建議合同中約定If the head of development in accordance with a medical certificate permanently no longer able to fulfill its duties under this contract, the employment contract expires at the end of the month in which a doctor

27、has reached that conclusion. The permanent incapacity is indisputably assumed if a disease-related disability uninterrupted nine months or a longer period. In the event of termination of employment due to permanent disability, the development manager is entitled to a severance payment of three times
