2、聯系人:Telephone: Contact person:簽約地址:Place of Execution:根據有關法律、法規,在自愿、平等、協商一致的基礎上,在熟悉、了解物業設施狀況的情況下,甲方將求真樓1號樓委托乙方實行外圍及公共設施區域整體物業管理,訂立本合同。This Con tract is en tered in to on the followi ng terms and con diti ons in accorda nce with releva nt laws and regulatio ns and on the basis of volun tari ness, equ
3、ality, mutual agreeme nt, based on ack no wledgeme nt and un dersta nding of the status of the facilities of the Property, whereby Party A en trusts Party B with overall property man ageme nt of the surro unding and public facility areas of Block 1 of Qiuzhe n Build ing.、物業基本情況Article One Basic Info
4、rmation of the Property物業類型:標準辦公樓Type of Property: Stan dard Office Buildi ng座落位置:常熟市湖山路99號常熟理工學院東南校區求真樓1號樓Location Site: Block 1, Qiuzhen Building, SoutheastCampus, Changshu Institute of Tech nology, No.99,Hushan Road, Cha ngshu City.管理服務類型:求真樓1號樓物業管理。Type of man ageme nt service: Block 1 Qiuzhe n
5、Build ing property man ageme nt二、本合同中術語的定義Article Two. Definition管理區域: 是指求真樓1號樓區域。Management area: Block 1 Qiuzhen Building area. 業主:是指物業的所有權人。Owner: Owner of the Property. 管理公司:是指在物業前期由開發商委托根據物業管理服務合同進行專業管理服務的江蘇XXXXXX服務外包(集團)有限公司。Man ageme nt compa ny: IService (Jia ngsu ) Group, which con ducts pr
6、ofessi onal man ageme nt service pursua nt to the Property Service Con tract in early stage of the Property as en trusted by the developer. 共用部位:是指整棟建筑內業主所有且共同使用的部位,其中包括(但不限 于)入八口、大堂、外墻、天臺、樓道、樓梯、樓梯間、電梯間、平臺、垃圾房、廁所、貨梯機房、電表房、泵房、共用倉庫、消 防中心、電話機 房、天井、水箱。Com mon Parts: Parts owned and com mon ly used by al
7、l owners in the build ing, in clud ing but not limited to entran ce, lobby, exter nal wall, balc ony, corridor, stair, stairway, elevator, platform, garbage room, toilet, freight elevator machine room, meter room, pump room, shared warehouse, fire fighti ng cen ter, teleph one room, patio and water
8、tank.共用設備:是指整棟建筑內業主所有且共同使用的設備,其中包括(但不限 于)電梯系統、通風系統、防火設備、消防系統、保安監控系統、給、排水系統、污水處理系統、強弱電系統等。Common equipme nts: Equipme nt owned and com monly used by all owners in the build in g, in cludi ng but not limited to elevator system, ventilation system, fire fighting system, security monitoring system, wate
9、r supply and drainage systems, sewage treatment system, strong and weak electricity systems, etc.公共設施:是指管理區域內歸全體業主所有或共同使用的設施(共用設施除 外),其中包括(但不限 于)照明路燈、排水管道、水景、窖井、 化糞池、垃圾房、配電房等設施。Common facilities: Facilities owned and commonly used by all owners in the management area other than share facilities, inc
10、luding but not limited to road lighting, drainage pipeline, waterscape, pit well, septic tank, garbage room, distributing substation, etc.公共區域: 是指管理區域內歸全體業主所有或共同使用的部位和場所 (共用 部位除外) , 其中包括 (但 不限于)道路、綠地、停車場庫等部 位和場所。Common areas: Parts and venues owned and commonly used by all owners in the management a
11、rea other than shared facilities, including but not limited to road, greenbelt, parking lot, etc.三、甲方的權利與義務Article Three Party A ' s Rights and Obligations 1 監督乙方管理工作的實施;Oversee the implementation of Party B ' s management.2. 按期支付乙方的物業管理費用;Pay property management fee to Party B when due.3提供乙
12、方物業管理有關所需的裝潢平面圖紙、電氣線路圖、消防驗收批文;Provide decorating plane drawings, electric wiring diagram, fire inspection approval required in connection with Party B' s property management.4自用部位、自用設備自行負責管理、保養、維修或根據房屋租賃合同或 XXXXXX 常熟站點委托建設及裝修合同要求乙方保養、維修;Manage, maintain and repair occupied parts and private equi
13、pments or request Party B to maintain or repair in accordancewith the House Lease Contract or Changshu Site Decoration Agreement.5. 配合乙方做好物業管理中的其它協調工作;Cooperate with Party B in other coordination work in property management.四、乙方的權利與義務Article Four Party B ' s Rights and Obligations1. 遵守有關法律、法規及本合
14、同的約定. 制定詳細的物業管理工作計劃Comply with relevant laws and regulations and provisions of this Contract, and formulate specific property management plan.2. 對業主和物業使用人有違反法律法規的行為,提請有關部門處理。Report to relevant authority on the violations of laws and regulations committed by property owners and users.3. 在求真樓 1 號樓二樓建設
15、可同時提供100 人同時用餐的餐廳。 甲方支付餐廳租金并承擔水電費Build up a canteen which can seat 100 people on the Second Floor, Block 1 of the Qiuzhen Building.4. 向業主和物業使用人書面告知物業使用的有關規定, 當業主和物業使用人裝修物業時,書面告知有關限制條件,并負責監督。Notify property owners and users in writing of rules in connection with property management, and notify them o
16、f relevant restrictions thereon in case property owners and users decorate the Property, and shall be responsible for oversight thereof.五、物業管理范圍:Article Five Scope of Property Management1. 求真樓1 號樓區域的共用部位。Common parts of Block 1 of Qiuzhen Building;2. 求真樓1 號樓區域的共用設備。Common equipment of Block 1 of Qiu
17、zhen Building;3. 求真樓1 號樓區域的公共設施。Common facilities of Block 1 of Qiuzhen Building;4. 求真樓1 號樓二樓的餐廳。Canteen of 2 nd Floor of Block 1 of Qiuzhen Building.六、 物業管理服務內容:Article Six Content of Property Management Services1 求真樓外觀:完好整潔,室外設備安裝有序。Qiuzhen Building appearance: Intact and clean, orderly installati
18、on of outdoor facilities.2 公共環境衛生: Public and environmental hygiene 1) 1) 求真樓區域道路、停車點及公共走道、明溝、大廳、二樓餐廳、電梯廳、照明燈具、樓道、樓梯扶手、樓道玻璃、屋面、水泵房、配電房、電梯間及電梯機房等有專人負責保潔。Cleaners put in place in charge of cleaning of the roads, parking spots, public walkways, open trenches, lobbies, 2 nd floor canteen, elevator hall,
19、 lighting, corridors, staircase rails, corridor glasses, roofing, pump room, distributing substation, elevator hoistway and elevator machine room of Qiuzhen Building area.求真樓區域做好除蟲害工作, 每月安排專業除蟲害公司來做除害工作, 必須確保求真樓 里沒有老鼠等蟲害。 (費用由大樓業主分攤) 2)Conduct insect pest removal in the Qiuzhen Building area, for th
20、at purpose a professional pest removal company shall be engaged to do pest removal work each month to ensure there are no insect pests such as mice.( 3 )配備垃圾箱、做到生活垃圾每日清運。Dust bins are provided and domestic garbage is removed each day.(4)求真樓區域外的門前保潔,委托環衛部門操作。Cleaning in front of the door of the Qiuzh
21、en Building area is entrusted to the public sanitation department.(5)真樓1號樓外墻每年清洗一次。(費用由大樓業主分攤)Exterior wall of Block 1 of Qiuzhen Building shall be cleaned once a year.3. 公共區域安全管理:Security Management of the Public Area:(1)保安全天候巡邏、控制閑雜人等進入辦公樓區域。24/7 patrol by security guards, precluding people withou
22、t fixed duties from entry into the office building area;(2)機動車與非機動車停放有序,保持道路暢通。Motor vehicles and non-motor vehicles park orderly to enable the road unclogged.(3)機動車停車實行無償服務,給予固定停車位10個。Motor vehicles are parked free of charge and given 10 fixed parking spaces.提供非機動車停放,搭建停車棚供甲方使用,至少提供200輛自行車 的停放。車棚建造
23、費用由大樓業主分攤。Provide park ing space for non-m otor vehicles, and con struct a park ing shed for Party A, which can accommodate at least 200 bicycles.4. 特約服務:Special services:(1)水電費由委托方直接支付給常熟理工學院,付款信息如下。Water and electricity fees will be paid to Changshu Institute of Tech no logy ;受益人名稱常熟理工學院銀行帳號322019
24、86152050594557受益銀行名稱常熟建行城中支行 對于房屋租賃合同或xxxxxx常熟站點委托建設及裝修合 同未涉及的部分,接受甲方提出 的自用部位、自用設備的維 修并合理收取費用。Accept repairs of occupied parts and private equipme nt applied by Party A for those areas not covered in the House Lease Con tract or Chan gshu Site Decorati on Agreeme nt and may charge reas on able fees
25、thereof;(3)代辦其它方面報修項目。En trusted with other repairs.5. 設備運行及維護保養:Equipme nt operati on and maintenance(1) 由大樓業主分攤樓區下水道疏浚費用,每一年疏浚二次( 其中 一次搖車進場 ) , 確保下水道暢通。Sewer dredg ing in the pla nt area, dredgi ng twice a year (in clud ing rock ing cart, a kind of hoist) to en sure un clogged sewer.(2) 由大樓業主分攤費用及
26、時更換損壞的窨井蓋座。Promptly replace damaged pit well cover.(3) 對落水管道進行日常維護,確保下水暢通。Con duct rout ine maintenance of dow nspout pipe to en sure un clogged sewer.(4) 由大樓業主分攤費用對二級生化處理池由物業公司進行日常疏通、保養。Secon dary biochemical treatme nt pond is dredged and maintained routi nely by the Property Compa ny.( 5 ) 由大樓業主分
27、攤費用定時清洗水箱,保證水質衛生。Regularly clea n the water tank to en sure water san itati on.( 6 ) 由大樓業主分攤費用定期進行除蟲害工作。Regularly remove in spect pests.( 7 ) 做好配電房、水泵房日常維護、保養工作。Con duct routi ne maintenance and repairs of the distributi on substatio n and water pump room.( 8 ) 及時更換損壞的垃圾桶。Promptly replace damaged ga
28、rbage bins.( 9 ) 對 機動車停車點定期劃線(油漆);自行車車棚維護保養,一年 兩次定期進行油 漆。 Regularly do linework ( paint ) for vehicle parking spots; maintain and repair bike shelter, regularly paint it twice a year.( 10 ) 對大樓內避雷針的維護、保養, 保持暢通。對大樓區內消防系 統進行日常檢查、保養。 Repair and maintenance of arrestors in the pla nt area to keep them o

Repair and maintenance of fire protection system in the plant area.( 11) 由大樓業主分攤求真樓1 號樓內公共用電、用水等費用的支出。 Bear the expe nditure of public electricity and watercon sumpti on in Block 1 of Qiuzhe n Build ing.( 12 ) 由大樓業主分攤分攤電梯運行的操作和日常保養及年檢費用。 Operati on and routi ne maintenance and annual in sp
30、ect ion of elevators.( 13 ) 由大樓業主分攤分攤承擔電梯水泵日常運行費用的支出。 Bear the expe nditure of rout ine operati on cost of elevator and water pump.( 14 ) 急修二十分鐘到現場, 24 小時修理完畢。 For emergency repair, arrive at the site in 20 minutes and complete repair in 24 hours.( 15) 小修當天報修,三十分鐘到現場,當天處理,一般不超過三天。 Arrive at the site
31、in 30 minu tes for small repair applied on the day, make treatme nt on the very day, gen erally not exceedi ng 3 days.七、物業管理服務費用及期限Article Seven Property Management Services Fees and Term1 ?收費標準:運營場地整體物業管理,收費標準按建筑面積每平方米36元人民幣/月收取。每年物業費在上一年度基礎上上漲5%Rate of charge: Con duct overall property man ageme n
32、t of the sites, the rate of charge shall be RMB 1.5 Yua n per square meters of con struct ion area per mon th;2?物業管理費按本協議及甲方委托之內容收取,甲方按季支付管理費,Property management fee shall be collected in accordanee with this Agreement and Party A' sentrustment. Party A shall pay property man ageme nt fee on a q
33、uarterly basis.2.1 真樓1號樓4樓物業費收費標準從xxxxxx年5月 1日至2017年4月30日;thThe rate of property man ageme nt fee for 4 Floor, Block 1, Qiuzhe n Buildi ng shall apply from May 1, xxxxx tcXApril 30, 2017.2.2 真樓1號樓3樓物業費收費標準啟用日開始至2017年4月30日;rdThe rate of property man ageme nt fee for 3 Floor, Block 1, Qiuzhe n Build i
34、ng shall apply from the comme nceme nt date to April 30, 2017.2.3 服務到期后如乙方選擇續租,甲方承諾在上述價格基礎上給予優惠。If upon expiration of the service Party B chooses to renew the lease, Party A undertakes to offer favorable discounts on the basis of the above-me nti oned rate.2.4 水電價格將根據常熟市電力局、自來水公司給到常熟理工學院的價格的變動而變動,但不
35、得高于常熟市電力局、自來水公司給到常熟理工學院的價格。The rate of water and electricity shall float with but shall not be higher tha n the rate Chan gshu Electric Power Bureau, r unning water compa ny offers to Chan gshu In stitute of Tech no logy.3.物業管理服務期限:1) Term of Property Man ageme nt Services:1.1 求真樓4樓自xxxxxx年5月1日至2017
36、年4月30日;Fourth Floor of Qiuzhe n Buildi ng, comme nces from May 1, xxxxx and expires on April 30, 2017.3.2 求真樓3樓自啟用日至2017年4月30日。Third Floor of Qiuzhen Building, commencesfrom the opening day and expires on April 30, 2017.3.3 但如果甲方與江蘇xxxxxx服務外包(集團)有限公司之間的租賃協議因任何原因被終止的, 本協議同時終止,在本合同項下任何一方不需承擔違約責任。Provi
37、ded, however, i n case the Lease Agreeme nt betwee n Party A and iService (Jiangsu) Group is terminated for any reason, this Agreement shall terminate simultaneously, and either Party hereto shall not be liable for breach of contract to the other Party.4. 甲方收到乙方物業管理費和水電費通知后, 在十日內支付。 甲方如逾期交 納管理費、水電 費
38、,乙方可以按逾期天數每天加收應交費用萬分之五的 滯納金。Upon receipt of Party B ' s notification of property management fee and water and electricity fees, Party A shall pay the same within 10 days. If Party A delays in payment of property management fee and water and electricity fees, Party B is entitled to a penalty of 0
39、.05% of the fees for each day of delay.5. 甲方延期交付水電費超過三個月后,滯納金則按每天千分之一計收。 In case Party A delayed payment of water and electricity fees exceeds three months the penalty rate shall be 0.1% of the fees for each day of delay.八、乙方物業維修內容概述:Article Eight Party B ' s free property maintenance content ov
40、erview 按國家及地方有關法規規定執行。 ( 法規中未明確的,按行業標準執行) 乙 方物業為下列項目提供維修服務,并按市場價收取費用National and local relevant regulations shall apply. (if not specified in the regulations, industrial standards shall apply)1. 外墻屋面的修繕工作。Reparation of exterior wall and roofing.2. 道路損壞部分的修復工作。Recovery of damaged part of road.3. 對受損的
41、落水管進行修繕及更新。Reparation and replacement of damaged downspout pipe.4. 二級生化處理池每兩年進行一次內部設備更新及大、中修項目。The secondary biochemical treatment pond undergoes twice a year internal facility replacement and big and medium-repair items.5. 高壓配電房每兩年進行一次電試。配電房內部設備更新及大、中 修項目。HV distributing substation undergoes twice

Internal facility of the distributing substation undergoes replacement and big and medium-repair items.6. 水泵房易損件的更換及大、中修項目。Replacement of wearing parts in the water pump room and big and medium-repair items7. 電梯零部件更換及大、中修項目。Replacement of elevator main parts and big and medi
43、um-repair items8. 公共走道內墻的定期粉刷及維修。Regular whitewashing and repair in the interior wall of public sidewalks.9. 園區內所有公共管道的修繕工作。Reparation of all pubic pipes in the park.10. 消防設備設施的定期更換。Regular replacement of fire prevention equipment and facilities.九、業主和物業使用人的自用部位、自用設備的維修保養,在甲方提出委任時乙方必須接受委托并合理收取費用。Arti
44、cle Nine In case Party A makes entrustment with respect to maintenance and repairs of occupied locations and private equipment of property owners and property users, Party B shall accept the entrustment and may charge reasonable fees thereof.十、其它Article Ten Miscellaneous1. 雙方可對合同的條款進行補充,以書面形式簽訂補充協議,
45、補充協 議與本合同具有同 等效力。The Parties thereto may sign supplementary agreements to the Agreement which shall be made in writing and shall have the same force and effect as this Agreement.2. 甲乙雙方在合同期內,如無法定或合同約定的理由而單方面解除本合同視為違約,違約方應向對方支付違約金。違約金以三個月的物 業管理費為標準。During the term of the Agreement, either Party'
46、s unilateral terminationof this Agreement without legal cause or cause provided hereunder shall be deemed as breach of contract, and the defaulting Party shall pay liquidated damages in the amount of three months ' property management fee to the other Party3. 甲方在本協議有效期內,將物業使用權或產權轉讓于第三方的, 本 協議的效力及于 第三方。If during the term of the Agreement, Party A transfers the right of use or ownership of the property to a third party,
