1、吉林省規范行政處罰裁量權辦法(2013 年 2 月 19 日省政府第2 次常務會議審議通過吉林省人民政府令第 239 號第一條為了規范行政處罰裁量行為，保證公正執法，保護公民、法人和其他組織的合法權益，根據中華人民共和國行政處罰法及有關法律、法規的規定，結合本省實際，制定本辦法。第二條本辦法所稱行政處罰裁量權，是指行政處罰實施機關在法定的行政處罰權限范圍內，對公民、法人和其他組織違反行政管理秩序的行為，決定是否給予行政處罰、給予何種行政處罰和給予何種幅度行政處罰的權限。本辦法所稱行政處罰實施機關，是指具有行政處罰權的行政機關、法律和法規授權實施行政處罰的組織。第三條本省各級人民政府所屬行政處罰

41、ts offire（四 ）法律、法規、規章規定不予處罰的其他情形。違法行為在2 年內未被發現的，不再給予行政處罰。法律另有規定的除外。第十二條當事人有下列情形之一的，應當依法從輕或者減輕處罰：（一 ）已滿 14 周歲不滿18周歲有違法行為的;（二 ）主動消除或者減輕違法行為危害后果的;（三 ）受他人脅迫有違法行為的;（四）配合行政機關查處違法行為有立功表現的;（五）法律、法規、規章規定應當從輕或者減輕處罰的其他情形。第十三條行使行政處罰裁量權時，應當執行告知、聽證、說明理由、回避、集體討論決定等相關規定。第十四條行使行政處罰裁量權時，應當充分聽取當事人的陳述、申辯，并記錄在案;在案件調查報告和
