(勞動安全衛生專項集體合同一般應在建筑、化工、交通、冶金、礦山等危險程度較高、職業危害嚴重、事故多發行業的企業簽訂) (Collective Contract on Labor Safety and Hygiene monly applies to the enterprises with high criticality, severe oupational hazard and frequent aident, such as construction, chemical, transportation, metallurgy, mine field, and so on. 第一條 本合同由_ (單位)與_ 工會根據勞動法、安全生產法、職業病防治法等法律法規以及省、市有關條例規定,結合本企業實際情況,經企業代表和職工代表協商一致簽訂。 Article 1 The contract is established between_ and the Trade Union of _ in aordance with “Labor Law”, “Safe Production Law”, “Oupational Disease Prevention and Cure Law” and related provincial and municipal regulations, based on the actual situation and subject to the equal consultation between Companys representative and employees representative. 1.企業依照國家有關法律法規,加強安全生產管理。建立健全安全生產責任制,勞動安全衛生制度;組織編制安全生產規章制度、安全操作規程及崗位操作規程,組織制定實施安全生產事故應急救援預案。 Company must strengthen the production safety management aording to relevant laws and regulations. Company should set up the system of job responsibility and the system of safe production and hygiene, organize to work out internal rules and regulation, operational instructions, post operation rules as well as the emergency solution for production aident. 2.企業應不斷改善勞動條件。有計劃地進行安全設施的更新改造,提供資金保證,確保??顚S?。 Company should gradually improve the working environment. It should designedly modify the facilities for safe production and hygiene, afford fund and insure its special use. 3.企業應對職工進行勞動安全衛生教育和培訓,未經培訓合格不得上崗作業。特殊工種作業人員必須經過國家有關部門培訓,取得相應資格操作證后,方可安排其從事作業。 Company should organize education and training on safe production and hygiene while people who fail or have not attended the safety training are not allowed for operation. Operators designed to special positions can start work only after obtaining the related qualification. 4.企業根據各工種的崗位需要,為職工提供符合國家標準及行業標準的勞動保護用品。對不按規定穿戴和不正確使用勞動保護用品和違反操作規程的職工,有權查處。 Company should provide personal protective equipment of national and industry standards, aording to different position requirements. Company is entitled to give opinions and investigate the liabilities of the employees who dont dress or use the protective equipment aording to the requirements. 5.企業對直接從事有毒有害崗位的職工,進行上崗前、離崗時的健康檢查,每年定期進行健康檢查,并建立職業衛生健康檔案。對其他崗位的職工,也應定期進行體檢。并及時向工會通報職業病檢查情況。 Company should organize the employees directly engaged in toxic and hazardous operations to take the health checkup before and after the related work, and individual health files are archived for operators of this nature. Scheduled health checkup should also be carried out for the employees of other positions. The result of oupational disease checkup should be announced to trade union. 6.企業依法按國家、省、市規定要求和時限為職工辦理工傷保險,并按時足額繳納工傷保險費用。職工因患職業病或因工受傷的工資和醫療費,按國家和省、市有關規定執行。 Company should cover the employees with industrial injury insurance in aordance with the law by national, provincial and municipal requirements and time limits, as well in full and on time pay the cost of industrial injury insurance. Medical expenses and wages for workers suffering from oupational diseases or work-related injuries should be paid aording to the national, provincial and municipal implementation of the relevant provisions. 7.在生產過程中發生工傷事故和嚴重職業危害時,企業應及時報告工會,工會有權依法參加事故調查,提出處理意見并要求追究有關人員的責任。 The ourrence of industrial injury and serious oupational hazard during production process should be reported timely to Trade Union; Trade Union is entitled to inquire into the case and give opinions, and furthermore investigate the liabilities of people in charge. 8.企業在研究制定和修改勞動安全衛生規章制度、安全技術措施時,工會應參加,涉及職工勞動安全衛生健康的重大問題,須經職工代表大會(職工大會)討論審議通過。 The Trade Union should take pert in the studying and amending rules and regulations on labor health and safe production, as well as safety techniques; any major issues concerning employees safety and health should be consulted and approved by the Employees Representative Convention. 9.工會支持企業加強安全生產管理,積極協助行政落實企業安全衛生規章制度,監督國家勞動安全衛生法規的執行。工會有責任教育職工嚴格遵守企業的各項安全生產規章制度和操作規程,教育和組織職工接受安全技術培訓和管理。 Trade Union should support the Company to strengthen production safety management, actively assist the Company in the implementation of health and safe production rules and regulation. Trade union has the responsibility of educating workers to strictly abide by the rules and regulations related to industrial safety, the responsibility of educating and organizing employees to receive safety techniques training and management. 10.工會有權糾正違章指揮,對強令工人冒險作業行為或當發現明顯事故隱患和職業危害時,有權停止作業并提出解決的建議,行政應當及時研究答復;當發現危及職工生命安全的情況時,有權組織職工撤離危險場所。 Trade Union is entitled to correct improper instruction and stop the operation and proposes the solutions when workers take the risk or apparent danger or oupational hazards are observed; the Company should make the decision and action thereafter. Trade Union is authorized to evacuate employees out of the dangerous places when their lives are expected to the hazard. 11.其他由企業、職工提出要求協商的與勞動安全衛生有關的問題。 Other issues regard to health and labor safety put forward by Company and employees for further consulting. 第二條 本合同由集體合同監督檢查小組負責監督,企業應每年不少于一次向職工代表大會(職工大會)報告勞動安全衛生協議履行情況。 Article 2 The supervision group of the collective contract is responsible for superintending the execution of the present contract. Company should report the implementation of the contract to the Employees Representative Convention at least once every year. 第三條 本合同有效期為 年,自 年 月 日起至 年 月 日止,并于期滿前三個月內進行下一輪勞動安全衛生集體協商。 Article 3 The validity of the con
