MAJORNON-CONFORMITIES

TheMaritimeSafetyCommittee,atitsseventy-sixthsession(2to13December2002),andtheMarineEnvironmentProtectionCommittee,atitsforty-eighthsession(7to11October2002),havingrecognizedtheneedfortheaforementionedprocedures,approvedtheProceduresconcerningobservedISMCodemajornon-conformities,setoutintheannex,withaviewtoassistingflagStatesandportStateswhenmajornon-conformitiesinaship,soracompany5ssafetymanagementsystemhavebeenobserved.

MemberGovernmentsareinvitedtoapplytheannexedProceduresandbringthemtotheattentionofthepartiesconcerned.

PROCEDURESCONCERNINGOBSERVEDISMCODE

MAJORNON-CONFORMITIES

Administrationsandrecognizedorganizationsactingontheirbehalfshouldensurethattheyarefullycognizantofuncorrectedmajornon-conformityraisedatISMCodeaudits.Amajornon-conformityfoundmaybedowngradedtoanon-conformityiftheAdministrationorrecognizedorganizationissatisfiedthateffectivecorrectiveactionisbeingtaken.Amajornon-conformityraisedonashipshouldbedowngradedbeforetheshipsails.Aschedulenotexceedingthreemonthsshouldbeagreedforcompletionofthenecessarycorrectiveactions.WheretheAdministrationallowsamajornon-conformitytobedowngraded,atleastoneadditionalauditshouldbecarriedoutwithinthetimeframeindicatedintheagreedcorrectiveactionplantoverifythateffectiveactionsaretaken.

UponrequestoftheportState,theAdministrationshouldproviderelevantinformationavailabletotheAdministrationconcerningthecurrentvalidityoftheDocumentofCompliancepresentedbytheship.

IntheeventmorethanoneAdministrationand/orrecognizedorganizationisinvolvedintheISMcertificationprocess,anymajornon-conformitythatleadstowithdrawalofaDocumentofComplianceorSafetyManagementCertificate,orthathasbeenallowedtobedowngradedandthatcorrectiveactionshavebeensatisfactorilycompleted,theinvolvedAdministrationand/orrecognizedorganizationshouldreporttheactiontakentotheotherAdministrationand/orrecognizedorganization.

AcompanywhoseDocumentofCompliancehasbeenwithdrawnshouldnotbeissuedwithanInterimDocumentofCompliance.Furthermore,anewDocumentofComplianceshouldnotbeissuedunlessaninitialverificationoranadditionalverificationtotheextentandscopeofaninitialverificationhasbeencarriedout.ThenewDocumentofComplianceshouldhaveanexpiιydate,thesameasthewithdrawndocument.

WheretheassociatedSafetyManagementCertificatesarewithdrawnasaresultofthewithdrawalofDocumentofCompliancecausedbyamajornon-conformity,newSafetyManagementCertificatesshouldnotbeissuedunlesstheDocumentofCompliancehasbeenreinstatedandaverificationtothescopeofaninitialverificationhasbeencarriedoutonboardtheshipsonarepresentativesamplebasis.Atleastoneshipofeachtypeoperatedbythecompanyshouldbeverified.

ForashipwheretheSafetyManagementCertificateappearsvalid,buttheCompany5sDocumentofCompliancehasbeenwithdrawn,theAdministrationoraportStateascertainingthewithdrawalshouldensurethattheshipdoesnotoperateuntiltheDocumentofComplianceisreissued.Suchstepsmayincludedetention,revocationofoperatingpermitsorotheractionnecessarytoensurecompliancewiththeISMCode.

ForashipwheretheSafetyManagementCertificatehasbeenwithdrawn,theAdministrationorportStateascertainingthewithdrawalshouldensurethattheshipdoesnotoperateuntiltheSafetyManagementCertificateisreissued.Suchstepsmayincludedetention,revocationofoperatingpermitsorotheractionnecessaιytoensurecompliancewiththeISMCode.

ForashipwhoseSafetyManagementCertificatehasbeenwithdrawnasaresultofmajornon-conformity,anInterimSafetyManagementCertificateshouldnotbeissued.Furthermore,anewSafetyManagementCertificateshouldnotbeissuedunlessaninitialverificationoranadditionalverificationtotheextentandscopeofaninitialverificationhasbeencarriedoutonboardtheship.Inaddition,dependingonthenatureofthemajornon-conformityraisedagainsttheSafetyManagementSystemimplementedonboardtheship,thevalidityoftheDocumentofComp
