10、dertakenbyPartyBasagreedinthisContractandtheremainingportionshallbereturnedtoPartyBwithoutinterest.5.2 租賃期間內發生的電費、電話(通訊)費等房屋使用費用由乙方承擔；物業管理費由甲方承擔。5.2 Thecostarisingfromwater,electricity,gas,telephonecall(communication)andTVandsoon(etc.)duringtheleasingperiodshallbeundertakenbyPartyB;propertymanagemen

Houseuserequirementsandmaintenanceresponsibility6.1 租賃期間，乙方發現該房屋及其附屬設施有損壞或故障時，應及時通知甲方修復；甲方應在接到乙方通知后的日內進行維修。逾期不維修的，乙方可代為維修，費用由甲方承擔。6.1 Duringtheleasingperiod,ifPartyBdiscoversanydamageortroublewiththepremisesandtheaccessoryfacilities,PartyBshallt

12、imelynotifyPartyAforrepair;PartyAshallcarryouttherepairwithinday(s)afterreceivingthenotification.Incaseofdelayofrepair,PartyBmaymaketherepairinplaceofPartyAatthecostofPartyA.6.2 租賃期間，乙方應合理使用并愛護該房屋及其附屬設施。因乙方使用不當或不合理使用，致使該房屋及其附屬設施損壞或發生故障的，乙方應負責維修。乙方拒不維修的，甲方可代為維修，費用由乙方承擔。6.2 Duringtheleasingperiod,Part

13、yBshallmakereasonableuseofthepremisesandtheaccessoryfacilities.AnydamageortroublearisingfromimproperuseorunreasonableuseofthepremisesandaccessoryfacilitiesshallberepairedbyPartyB.IntheeventthatPartyBrefusestherepair,PartyAmaycarryouttherepairinplaceofPartyBatthecostofPartyB.6.3 租賃期間，甲方應保證該房屋及其附屬設施處于

14、正常的可使用和安全的狀態。甲方對該房屋進行檢查、養護，應提前日通知乙方。檢查養護時，乙方應予以配合。甲方應減少對乙方使用該房屋的影響。6.3 Duringtheleasingperiod,PartyAshallensurenormalavailabilityandsafestatusofthepremisesandaccessoryfacilities.IfPartyAintendstocarryoutinspectionandmaintenanceonthepremises,PartyAshallnotifyPartyBdaysinadvance.Duringtheinspectionand

15、maintenance,PartyBshallprovidecoordination.PartyAshallminimizetheinfluenceontheuseofthepremises.6.4 乙方需裝修或者增設附屬設施和設備的，應事先征得甲方的書面同意，按規定須向有關部門報批的，則應由甲方報請有關部門批準后，方可進行。乙方增設的附屬設施和設備的歸屬及其維修責任由甲、乙雙方另行書面約定。6.4 IncasethatPartyBintendstodecoratethepremisesoraddaccessoryfacilitiesandequipments,PartyBshallobtai

16、nwrittenpermissionfromPartyAinadvance;ifitisrequiredso,(PartyAPartyBentrustedbyPartyA)shallsubmitsuchbehaviortothecompetentdepartmentforapprovalbeforetheimplementation.TheownershipandmaintenanceoftheaccessoryfacilitiesandequipmentsaddedbyPartyBshallbeadditionallyagreedbybothpartiesinwrittenform.七、房屋

17、返還與續租VII. Housereturnandrentingrenewal7.1乙方應在本合同的租賃期限屆滿之后的日內返還該房屋，未經甲方同意逾期返還該房屋的，每逾期一日，乙方應以日租金向甲方支付該房屋占用期間的使用費。7.1 PartyBshallreturnthepremiseswithindaysaftertheterminationoftheleasingperiod,andincaseofanydelayforthereturnofthepremiseswithoutpermissionofPartyA,PartyBshallpayPartyAtheusefeeofthepremi

18、sesatthedailyrateequivalentto%ofdailyrentduringtheoccupationofthepremises.7.2 乙方如果需要續租的，應在租賃期限屆滿兩個月之前向甲方提出，甲方同意的，雙方另行簽訂相關續租文書。乙方在同等條件下享有優先承租權。7.2 IncasethatPartyBwantstorenewtheContract,PartyBshallraisetherenewalintentiontoPartyAtwomonthsbeforetheterminationoftheleasingperiod,andwiththeapprovalofPar

19、tyA,therenewalcontractwillbeadditionallysignedbetweenbothparties.Undertheequivalentcondition,PartyBshallhavethepriorityforobtainingthelease.7.3 租賃期限屆滿，甲乙雙方未續簽租賃合同，乙方繼續支付租金，甲方未表示拒絕的，則按法律相關規定，雙方之間成立不定期租賃關系。在不定期租賃關系中，甲方有權提前一個月通知乙方租賃關系終止。7.3 Aftertheterminationoftheleasingperiod,ifnorenewalcontractissig

20、nedbybothpartiesandPartyBcontinuespayingtherent,whichisnotrefusedbyPartyA,thenon-fixed-termleasingrelationsareestablishedbetweenbothpartiesaccordingtorelevantlawsandregulations.Duringsuchnon-fixed-termleasingrelations,PartyAshallhavetherighttoterminatetheleasingrelationsbynotifyingPartyBone(1)monthi

21、nadvance.7.4 乙方返還該房屋應符合正常使用后的狀態。返還時，應經甲方驗收認可，并相互結清各自應當承擔的費用。7.4 ThepremisesreturnedbyPartyBshallbeconsistentwiththestatusafternormaluseofthepremises.Uponreturnofthepremises,PartyBshallinspectthepremisesbeforeitsacceptanceandtherelevantfeesforrespectivepartiesshallbesettled.八、轉租與轉讓VIII. Subleaseandtr

22、ansfer8.1 除甲方已經在本合同中同意乙方轉租外，乙方在租賃期限內，不可將該房屋部分或全部轉租給他人。8.1 ExceptthatPartyAagreesinthisContractthatthepremisesmaybesubleasedbyPartyB,PartyBshallnotsubleasepartorallofthepremisestoanyotherpersonwithintheleasingperiod,withoutwrittenpermissionofPartyA.Anyhowonelivingroomintheoriginalhouseholdtypeshallno

23、tbeseparatedforsubleasing.九、解除合同的條件IX. Conditionsforcontractcancelation9.1 甲乙雙方同意在租賃期限內，有下列情形之一的，本合同終止，雙方互不承擔責任：9.1 Bothpartiesagreethatduringtheleasingperiod,thisContractshallbeterminatedneitherpartyneedingtoassuminganyresponsibilityincaseofanyofthefollowingsituations;(一) 該房地產占用范圍內的土地使用權依法提前收回的；(1)

24、 Theuserightofthelandoccupiedbytherealestatehasbeenlegallyretrieved;(二) 該房地產因社會公共利益被依法征用的；(2) Thepremisesareoccupiedbymeansoflegalrequisitionduetosocialandpublicinterests;(三) 該房地產因城市建設需要被依法列入房屋拆遷許可范圍內的；(3) Thisrealestatehastobelegallyputintothedismantlingrangeduetourbanconstruction;(四) 該房屋毀損、滅失或者被鑒定

25、為危險房屋的；(4) Thepremisesaredamaged,destroyedorverifiedasdangeroushouse;(五) 甲方已告知乙方該房屋出租前已設定抵押，現被處分的；(5) PartyAhasnotifiedPartyBthatthepremiseshavebeenpledgedbeforeleasingandnowhasbeendisposed;9.2 甲乙雙方同意，有下列情形之一的，一方可書面通知另一方解除本合同。違反合同的一方，應向另一方按月租金的倍支付違約金，給對方造成損失的，支付的違約金不足以抵付損失的，還應賠償造成的損失與違約金的差額部分：9.2 Bo

27、teddamagespaidbythebreachingparty,thebreachingpartyshallpaythedifferencebetweentheincurredlossesandtheliquidateddamages;(一) 甲方未按時交付該房屋，經乙方催告后日仍未交付的；(I) PartyAfailstohandoverthepremisesontime,andevendaysafterexigentnoticeofPartyB;(二) 甲方交付的該房屋不符合本合同的約定，致使不能實現租賃目的的；或甲方交付的房屋存在缺陷，危及乙方安全的；(II) Thepremises

28、handedoverbyPartyAdonotcomplywiththeagreementinthisContract,whichthereforemakesitimpossibletorealizetheleasingpurpose;orthepremiseshandedoverbyPartyAhavethedefectsendangeringthesafetyofPartyB;(三) 乙方在甲方按時交付該房屋的情形下，未能配合辦理交房手續，經甲方催告后日仍未配合辦理交房手續的；(III) InspiteofthetimelyhandoverofthepremisesbyPartyA,Par

29、tyBfailstocooperatetogothroughtheproceduresforthehandoverofthepremisesdaysaftertheexigentnoticeofPartyA;(四) 乙方未征得甲方書面同意改變該房屋用途，致使該房屋損壞的；(IV) PartyBchangedtheuseofthepremiseswithoutwrittenpermissionofPartyAandthereforeincurredthedamageofthepremises;(五) 因乙方原因造成該房屋主體結構損壞的；(V) Themainstructureofthepremi

30、sesisdamagedduetothereasonsofPartyB;(六) 乙方擅自轉租該房屋或轉讓該房屋承租權的；(VI) PartyBsubleasesthepremisesortransferstheleasingrightofthepremiseswithoutpermissionofPartyA;(七) 乙方逾期不支付租金累計超過天的；(VII) Partyfailstopaytherentuptomorethandays;十、違約責任X. Breachingliability10.1該房屋交付時存在缺陷的，甲方應自交付日起日內進行修復，逾期不修復的，甲方同意減少租金并變更有關租

31、金條款。10.1 Incaseofanydefectwiththepremisesatthetimeofhandover,PartyAshallmaketherepairwithindaysafterthehandover,andifnorepairismadeevenafterthestipulatedperiod,PartyAagreestoreducetherentandchangetheclauserelatedtotherent.10.2 租賃期間，甲方不及時履行本合同約定的維修與養護責任，致使該房屋損壞，造成乙方財產損失或人身傷害的，甲方應承擔賠償責任。10.2 Duringthe

32、leasingperiod,PartyAfailstotimelyperformthemaintenanceresponsibilityofthepremisesasagreedintheContract,whichthereforehasincurredthedamageofthepremises,thenanypropertylossorpersonalinjuryincurreduponPartyBshallbecompensatedbyPartyA.10.3 租賃期間，非本合同規定的情況，甲方擅自解除本合同，提前收回該房屋的，甲方應按月租金的倍向乙方支付違約金。若違約金不足以抵付乙方損

33、失的，甲方還應負責賠償。10.3 Duringtheleasingperiod,PartyAunilaterallycancelledthisContractandtookbackthepremisesinadvanceincaseofthesituationsotherthanthosestipulatedintheContract,PartyAshallpayPartyBtheliquidateddamagesequivalenttotimesofmonthlyrent.Iftheliquidateddamagescannotcompensateforthelossincurredupon

34、PartyB,PartyAshallprovidefurthercompensation.10.4 乙方未征得甲方書面同意或者超出甲方書面同意的范圍和要求裝修房屋或者增設附屬設施和設備的，甲方可以要求乙方恢復房屋原狀或賠償損失。10.4 IfPartyBdecoratesthepremisesoraddstheaccessoryfacilitiesorequipmentswithoutwrittenpermissionofPartyAorbeyondthescopeandrequirementsagreedinwrittenpermissionofPartyA,PartyAmayrequire

35、PartyBtorecoverthepremisestotheoriginalstate,orcompensatefortheloss.10.5 租賃期間，非本合同規定的情況，乙方中途擅自退租的，乙方應按月租金的倍向甲方支付違約金。若違約金不足以抵付甲方損失的，乙方還應負責賠償。10.5 Duringtheleasingperiod,incaseofthesituationotherthanthosestipulatedintheContract,PartyBstopstherenting,PartyBshallpayPartyAtheliquidateddamagesequivalentto

36、time(s)ofmonthlyrent.IftherentisnotenoughtooffsetthelossincurreduponPartyA,PartyBshallprovidefurthercompensation.十一、其他條款XI. Others11.1本合同及附件一自甲、乙雙方于本合同簽章處簽字或簽章后立即生效。11.1 ThisContractanditsAppendixIshallcomeintoeffectuponthesignaturesorsealstampingofPartiesAandB.11.2 本合同空格處填寫文字與鉛印文字具有同等法律效力，若填寫文字與鉛印文字相沖突，以填寫文字為準。若有未盡事宜，可簽訂補充協議進行約定，若補充協議與本協議相沖突，以補充協議為準。11.2 ThewordsfilledandprintedintheblankpartofthisContractshallhavesamelegalfo
