14、 buyer shall agree to postpone the delivery on theconditon that the Seller agrees of pay a penalty whichshall be deducted by the paying bank at the time ofpayment. The rate of penalty is charged at 0.5% of thetotalvalue ofthecargo whose deliveryhas been delayedfor every week, odddays less than a wee

15、k should becountedas a week. But the totalamount ofpenaltyshallnot exceed 5% of the total value of the cargo involvedin the late delivery. In case the Seller fail ot makedelivery10 weekslaterthanthetimeofshipmentstipulated on the contract, the Buyer shall havbe therighttocancelthecontracta nd theSel

16、lershallstillpay the aforesaid penalty to the Buer without delay.Quality / Quantity Discrepancy a nd Claim:In case the quality and/or quantity / weightare found the Buyers to be not in conformity with theContract after arrival of the goods at the port ofdestination,theBuyersmaylodgeclaimwiththeSelle

17、rssupportedby surveyreportissuedbyaninspection organizaiton agreed upon by both parties,withtheexception,however, ofthoseclaimsforwhichthe insurance company and/or the shipping company aretobe held responsible. Claim for quality discrepancyshould be filed by the Buyers within 30 days after arrival o

18、f the goods at the port of destination, while for quantity/weight discrepancy claim should be filed by the Buyers within 15days after arrival of the goodsat port of destination.
