1、實用文檔 房屋租賃合同 出租方(甲方):XXX有限公司 Lessor (Party A): XXXMan ageme nt Co.,ltd 承租方(乙方): Lessee (Party B): 根據中華人民共和國合同法、上海市房屋租賃條例等相關法律法規 的規定,甲、乙雙方經丙方居間介紹,在平等、自愿、公平和誠信的基礎上,經協 商一致,就乙方承租甲方的房屋事宜,簽訂本合同,以資共同遵守: This Con tract is madeby Party C and betwee n both parties after n egotiati on on an equal, volun tary, f

2、air and good-faith basis in accorda nee with “ Con tract Lawof the People s Republic of Chi na ” ,“ Shan ghai Muni cipality Regulatio ns on the Leas ing of Build ing Premises” and other releva nt laws and regulations, with regard to the issue that Party B will rent the house of Party A: 一、出租房屋基本情況:(

3、下稱“該房屋”,實際情況以權屬證明或相關法律文書 的記載內容為準) 10.1 Basic in formatio nof the leased house: (here in afterreferred to as “ the premises ” , and the actual situation shall be based on the ownership certificati on or the records of releva nt legal docume nts) 1.1 房屋類型: 1.1 Type of the premises: 1.2 房屋座落: 區 路 號 室。

Usage of the ren ted premises 乙方向甲方承諾,租賃該房屋作為 使用,并遵守國家和本市有關于房 地產使用和物業管理的規定。 Party B shall make commitment to Party A that the premi

5、ses shall be used as and shall abide by the regulati ons of real estate use and property man ageme nt in China and Shan ghai Muni cipality. 三、交付日期和租賃期限 III. Date of delivery and term of leasing 3.1 甲乙雙方約定,甲方應于_年月_日之前向乙方交付該房屋。交付時 甲、乙雙方在丙方見證下簽訂本合同之附件二房屋交接書。 7.1 Both parties have agreed that Party A sh

Under the witness of Party C, both parties shall sign Appendix II: Letter of House Handover at the time of delivery. 7.2 該房屋租賃期限自 _年_月_日起至_年月 _ 日止。 3.2 The premises are leased from , to ,. 四、租金、支付方式與支付日期 IV. Rent, method and time of payme nt (一) 甲乙雙方約定

7、,該房屋每月租金為(人民幣)元(大寫 元整) Both parties have agreed that the rent of the premises per month is (RMB) . 租金以個月為一期支付。乙方應于每期提前 _日前向甲方支付租金。 逾期支付的,每逾期一日,則乙方需按月租金的支付逾期違約金。 (二) The rent shall be paid with mon ths as a payme nt period. 9、: . 以上租金包含甲方出具租賃發票的費用、物業費等。 The above rent in cludes 五、保證金(押金)和其他費用 V. Guara ntee deposit (security deposit) and other fees 5.1甲乙雙方約定,在簽訂本合同時,乙方應向甲方支付房屋租賃保證金(押金), 保證金(押金)為人民幣 元(大寫_元整)。甲方收取該保證金(押金) 后應向乙方出具收款憑證。租賃關系終止時,甲方收取的房屋租賃保證金(押金) 除用于抵充本合同約定由乙方承擔的費用外,剩余部分無息歸還乙方。 (1) Both parties have agreed that

Upon receiving the guarantee deposit (security deposit), Party A sha

11、ll issue the receipt voucher to Party B. At the time of the term in atio n of leas ingrelati on, the guara ntee deposit (security deposit) collected by Party A shall be used to offset the fees undertaken by Party B as agreed in this Con tract and the remai ning porti on shall be returned to Party B

(2) 租賃期間內發生的電費、電話(通訊)費等房屋使用費用由乙方承擔; 物業管理費由甲方承擔。 5.2 The cost aris ing from water, electricity, gas, teleph one call (com muni catio n) and TV and so on( etc.) duri ng the leas ing period shall be un dertake n by Party B; property man ageme nt fee shall be un dertake n by ( Party A

13、 Party B). 六、房屋使用要求和維修責任 VI. House use requireme nts and maintenance resp on sibility 4.1 租賃期間,乙方發現該房屋及其附屬設施有損壞或故障時,應及時通知甲方 修復;甲方應在接到乙方通知后的 日內進行維修。逾期不維修的,乙方可代為維 修,費用由甲方承擔。 During the leas ing period, if Party B discovers any damage or trouble with the premises and the accessory facilities, Party B s

14、hall timely notify Party A for repair; Party A shall carry out the repair within day(s) after receiving the notification. In case of delay of repair, Party B may make the repair in place of Party A at the cost of Party A. 租賃期間,乙方應合理使用并愛護該房屋及其附屬設施。因乙方使用不當或 不合理使用,致使該房屋及其附屬設施損壞或發生故障的,乙方應負責維修。乙方 拒不維修的,甲

15、方可代為維修,費用由乙方承擔。 4.2 During the leas ing period, Party B shall make reas on able use of the premises and the accessory facilities. Any damage or trouble aris ing from improper use or un reas on able use of the premises and accessory facilities shall be repaired by Party B. In the eve nt that Party B

16、refuses the repair, Party A may carry out the repair in place of Party B at the cost of Party B. 4.3 租賃期間,甲方應保證該房屋及其附屬設施處于正常的可使用和安全的狀態。 甲方對該房屋進行檢查、養護,應提前日通知乙方。檢查養護時,乙方應予以 配合。甲方應減少對乙方使用該房屋的影響。 During the leasing period, Party A shall ensure normal availability and safe status of the premises and acce

17、ssory facilities. If Party A intends to carry out inspection and maintenance on the premises, Party A shall notify Party B days in advanee. During the inspection and maintenance, Party B shall provide coord in ati on. Party A shall mini mize the in flue nce on the use of the premises. 乙方需裝修或者增設附屬設施和

18、設備的,應事先征得甲方的書面同意,按規 定須向有關部門報批的,則應由甲方報請有關部門批準后,方可進行。乙方增設的 附屬設施和設備的歸屬及其維修責任由甲、乙雙方另行書面約定。 4.4 In case that Party B intends to decorate the premises or add accessory facilities and equipments, Party B shall obtain written permission from Party A in adva nee; if it is required so, ( Party A Party B en tr

19、usted by Party A) shall submit such behavior to the compete nt departme nt for approval before the impleme ntatio n. The own ership and maintenance of the accessory facilities and equipme nts added by Party B shall be additi on ally agreed by both parties in written form. 七、房屋返還與續租 VII. House retur

20、n and renting ren ewal 7.1 乙方應在本合同的租賃期限屆滿之后的 _日內返還該房屋,未經甲方同意逾 期返還該房屋的,每逾期一日,乙方應以日租金 向甲方支付該房屋占用期間的 使用費。 11.1 Party B shall return the premises within days after the termination of the leasing period, and in case of any delay for the return of the premises without permission of Party A, Party B shall

21、pay Party A the use fee of the premises at the daily rate equivale nt to % of daily rent duri ng the occupati on of the premises. 11.2 乙方如果需要續租的,應在租賃期限屆滿兩個月之前向甲方提出,甲方同意 的,雙方另行簽訂相關續租文書。乙方在同等條件下享有優先承租權。 7.2 In case that Party B wan ts to renew the Con tract, Party B shall raise the ren ewal inten ti o

22、n to Party A two mon ths before the term in ati on of the leas ing period, and with the approval of Party A, the ren ewal con tract will be additi on ally sig ned betwee n both parties. Un der the equivale nt con diti on, Party B shall have the priority for obtaining the lease. 7.3 租賃期限屆滿,甲乙雙方未續簽租賃合

23、同,乙方繼續支付租金,甲方未表示 拒絕的,則按法律相關規定,雙方之間成立不定期租賃關系。在不定期租賃關系中, 甲方有權提前一個月通知乙方租賃關系終止。 11.3 After the term in ati onof the leas ing period, if no ren ewal con tract is sig ned by both parties and Party B continues pay ing the rent, which is not refused by Party A, the non- fixed-term leas ing relati ons are es

24、tablished betwee n both parties accordi ng to releva nt laws and regulati ons. During such non- fixed-termleasing relations,Party A shall have the right to terminate the leas ing relati ons by no tify ing Party B one (1) mon th in adva nee. 11.4 乙方返還該房屋應符合正常使用后的狀態。返還時,應經甲方驗收認可,并 相互結清各自應當承擔的費用。 7.4 T

25、he premises returned by Party B shall be con siste nt with the status after normal use of the premises. Upon return of the premises, Party B shall in spect the premises before its accepta nee and the releva nt fees for respective parties shall be settled. 八、轉租與轉讓 VIII. Sublease and tran sfer 6.1 除甲方

26、已經在本合同中同意乙方轉租外,乙方在租賃期限內,不可將該房屋 部分或全部轉租給他人。 6.1 Except that Party A agrees in this Con tract that the premises may be subleased by Party B, Party B shall not sublease part or all of the premises to any other person within the leasing period, without written permission of Party A. 27、room in the orig inal household type shall not be separated for subleas ing. 九、解除合同的條件 IX. Con diti ons for con tract can celati on 4.1 甲乙雙方同意在租賃期限內,有下列情形之一的,本合同終止,雙方互不承 擔責任: 8.1 Both parties agree that duri ng the leas ing period, this Con tract shall be term in ated n either party n eedi ng to ass

28、u ming any resp on sibility in case of any of the follow ing situati ons; (一) 該房地產占用范圍內的土地使用權依法提前收回的; 11.1 The use right of the land occupied by the real estate has bee n legally retrieved; (二) 該房地產因社會公共利益被依法征用的; 11.2 The premises are occupied by means of legal requisiti on due to social and public

29、in terests; (三) 該房地產因城市建設需要被依法列入房屋拆遷許可范圍內的; 11.3 This real estate has to be legally put into the disma ntl ing range due to urba n con struct ion; (四) 該房屋毀損、滅失或者被鑒定為危險房屋的; 11.4 The premises are damaged, destroyed or verified as dan gerous house; (五) 甲方已告知乙方該房屋出租前已設定抵押,現被處分的; 11.5 Party A has notifie

30、d Party B that the premises have been pledged before leas ing and now has bee n disposed; 8.2 甲乙雙方同意,有下列情形之一的,一方可書面通知另一方解除本合同。違 反合同的一方,應向另一方按月租金的 倍支付違約金,給對方造成損失的, 支付的違約金不足以抵付損失的,還應賠償造成的損失與違約金的差額部分: 4.2 Both parties agree that either party maynotify the other party to cancel this Con tract in writte

31、n form in case of any of the followi ng situati on, and the party that breaches this Con tract shall pay the other party the liquidated damages equivale nt to time(s) of the mon thly rent, and in case that the losses in curred to both parties cannot be offset by the liquidated damages paid by the br

32、each ing party, the breachi ng party shall pay the differe nee betwee n the in curred losses and the liquidated damages; 甲方未按時交付該房屋,經乙方催告后日仍未交付的; 1.3 Party A fails to hand over the premises on time, and eve ndays after exige nt no tice of Party B; 甲方交付的該房屋不符合本合同的約定,致使不能實現租賃目的的;或甲方 交付的房屋存在缺陷,危及乙方安全的;

33、 1.4 The premises han ded over by Party A do not comply with the agreeme nt in this Con tract, which therefore makes it impossible to realize the leas ing purpose; or the premises handed over by Party A have the defects endangering the safety of Party B; 乙方在甲方按時交付該房屋的情形下,未能配合辦理交房手續,經甲方催告 后日仍未配合辦理交房手

34、續的; 1.5 In spite of the timely han dover of the premises by Party A, Party B fails to cooperate to go through the procedures for the han dover of the premises days after the exige nt no tice of Party A; 乙方未征得甲方書面同意改變該房屋用途,致使該房屋損壞的; 1.6 Party B cha nged the use of the premises without writte n permis

35、si on of Party A and therefore in curred the damage of the premises; 因乙方原因造成該房屋主體結構損壞的; 1.7 The main structure of the premises is damageddue to the reasons of Party B; 乙方擅自轉租該房屋或轉讓該房屋承租權的; 1.8 Party B subleases the premises or transfers the leasing right of the premises without permissi on of Party

36、A; 乙方逾期不支付租金累計超過 天的; 1.9 Party fails to pay the rent up to more tha ndays; 十、違約責任 X. Breaching liability 10.1該房屋交付時存在缺陷的,甲方應自交付日起 日內進行修復,逾期不 修復的,甲方同意減少租金并變更有關租金條款。 4.4 In case of any defect with the premises at the time of handover, Party A shall makethe repair with in days after the han dover, and

37、if no repair is made even after the stipulated period, Party A agrees to reduce the rent and cha nge the clause related to the rent. 5.5 租賃期間,甲方不及時履行本合同約定的維修與養護責任,致使該房屋損壞, 造成乙方財產損失或人身傷害的,甲方應承擔賠償責任。 10.2 During the leasing period, Party A fails to timely perform the maintenance resp on sibilityof the

38、 premises as agreed in the Con tract, which therefore has in curred the damage of the premises, the n any property loss or pers onal injury in curred upon Party B shall be compe nsated by Party A. 10.3 租賃期間,非本合同規定的情況,甲方擅自解除本合同,提前收回該房屋的, 甲方應按月租金的倍向乙方支付違約金。若違約金不足以抵付乙方損失的,甲 方還應負責賠償。 6.6 During the leas

39、 ing period, Party A un laterally can celled this Con tract and took back the premises in adva nce in case of the situati ons other tha n those stipulated in the Con tract, Party A shall pay Party B the liquidated damages equivale nt to times of m on thly ren t. If the liquidated damages cannot comp

40、e nsate for the loss in curred upon Party B, Party A shall provide further compe nsati on. 7.7 乙方未征得甲方書面同意或者超出甲方書面同意的范圍和要求裝修房屋或 者增設附屬設施和設備的,甲方可以要求乙方恢復房屋原狀或賠償損失。 10.4 If Party B decorates the premises or adds the accessory facilities or equipme nts without writte n permissi on of Party A or bey ond t

41、he scope and requireme nts agreed in writte n permissi on of Party A, Party A may require Party B to recover the premises to the original state, or compensate for the loss. 10.5 租賃期間,非本合同規定的情況,乙方中途擅自退租的,乙方應按月 租金 的倍向甲方支付違約金。若違約金不足以抵付甲方損失的,乙方還應負責賠 償。 8.8 During the leasing period, in case of the situa

42、tion other than those stipulated in the Con tract, Party B stops the renting. Party B shall pay Party A the liquidated damagesequivale nt totime(s) of mon thly ren t. If the rent is not eno ugh to offset the loss in curred upon Party A, Party B shall provide further compe nsati on. 十一、其他條款 XI. Other

43、s 本合同及附件一自甲、乙雙方于本合同簽章處簽字或簽章后立即生效。 This Con tract and its Appe ndix I shall come into effect upon the sig natures or seal stampi ng of Parties A and B . 本合同空格處填寫文字與鉛印文字具有同等法律效力,若填寫文字與鉛印文 字相沖突,以填寫文字為準。若有未盡事宜,可簽訂補充協議進行約定,若補充協 議與本協議相沖突,以補充協議為準。 The words filled and prin ted in the bla nk part of this Con tract shal
