承包合作經營協議書 甲方: 乙方: 甲、乙雙方根據中華人民共和國合同法及有關法律法規,經協商一致,簽訂本合同。 第一條甲方保證所租給乙方的場地符合國家對娛樂場所的有關規定。 第二條茶樓的坐落、面積、裝修、設施情況 1甲方承包給乙方的茶樓名稱: 。位于 2場所面積共 ,其中第一層 ,第二層 。租于乙方 3該場所現有裝修及設施、設備情況詳見合同附件。 該附件作為甲方按照合同約定交付乙方使用和乙方在承包期滿交還還給甲方時的驗收依據。 第三條承包期限、用途 1.該場所承包期限共_年。自_年_月_日至_年_月_日止。 2.承包期滿,甲方有權收回該場所,乙方應如期交還。 乙方如要求續承包,則必須在承包期滿_個月之前書面通知甲方,經甲方同意后,重新簽訂承包合同。 第四條承包金用支付方式 1該場所每年承包金為人民幣 元(大寫: )。 2承包金支付方式如下: a按月付款,每月承包金為人民幣 元(大寫: ),由乙方在每月 日前,將款項匯入甲方銀行帳戶: ,作為 (上或下)月份的承包金。 b自本同簽訂并生效后_天內,乙方支付甲方誠意金人民幣 元(大寫: 整),該款項作為乙方的預付承包金,甲方應開具相應的收款收據。 第五條承包期間相關費用及稅金 1甲方應承擔的費用: (1)在承包期間,根據甲方與 年 月 日簽訂的租賃合同,應當由甲方承擔或代繳的的相關費用,甲方應當按照合同的約定進行交納,以保證場所的正常運作和經營。 (2) 。 2乙方交納以下費用: (1)乙方應按時交納經營稅收、場地水電及其他與經營相關的費用,如不按時交納費用引起的后果則由乙方全部承擔責任。 。 第六條場所的修繕與使用 1在承包期限內,甲方保證該場所的使用安全(乙方使用不當除外),其它所屬硬件設施的維修責任由乙方自行負責。 a甲方提出進行維修須提前_日書面通知乙方,乙方應積極協助配合。 b對乙方的裝修裝飾部分甲方不負有修繕的義務。 2乙方應合理使用其所承包的場所及其附屬硬件設施。如因乙方使用不當造成房屋及設施損壞的,乙方應立即負責修復或者經濟賠償。 3乙方如改變房屋的內部結構、裝修或設置對房屋結構有影響的設備,設計規模、范圍、工藝、用料等方案均須事先征得甲方的書面同意后方可施工。 第七條 合作經營具體事項 1.由于在整個經營區內,甲乙雙方各自獨立經營茶和足道按摩項目,所以雙方應有各自獨立的水,電,氣,表。 2.獨立的法人代表以及國家要求的各種證件。 3.光纖網絡資源共享。由乙方分擔每月 元 4.接待大廳和廁所,走廊雙方公用,由 方負責管理和維護。 5.雙方工作人員若非業務需要不得在另一方經營場所內走動。 6.停車位公享。 7.乙方添置的各種設施,設備,在合同期滿后乙方擁有處置權。 8.雙方不得干預對方的經營和管理。 9.經營中產生的任何糾紛都必須由雙方負責人商議解決。不可單方解決。 第八條合同的變更、解除與終止 1本合同生效后具有法律約束力,甲、乙雙方均不得隨意變更或者解除本合同,需要變更或解除時,須經雙方協商一致達成新的書面協議。 2甲方有以下行為之一的,乙方有權解除合同: (1)提供不符合約定條件的場所設施,嚴重影響經營。 (2)甲方未履行房屋的修繕義務,嚴重影響經營。 3在承包期間,乙方有下列行為之一的,甲方有權解除合同,收回所承包給乙方的場所: (1)未經甲方書面同意,拆遷變動場所房屋結構。 (2)未經甲方書面同意,不得應用于場所經營用途以外的用途。 (3)利用所承包的場所進行非法活動。 (4)未按約定交納承包費逾期一個月。 4承包期滿合同自然終止。 5因不可抗力因素導致合同無法履行或者無法完全履行時,甲、乙雙方協助商一致,可以變更或者解除合同。 第九條場所交付及收回的驗收 1甲方應保證承包期間場所本身及附屬設施、設備處于正常使用狀態。 2驗收時雙方共同參與,如對裝修、器物等設施有異議應當場提出。當場難以檢測的,應于_日內向對方提出異議。 3乙方應于承包期滿后,將承包場所及附屬設備、設施如數交還給甲方。 4乙方交還甲方的場所及附屬設施應保持完好的狀態,不得留下物品或者影響場所的正常經營。對未經同意留下的物品,甲方有權處置。 第十條違約責任 1甲、乙雙方應全面實際履行本合同,不履行或者不完全履行的應負違約責任。 2承包期間,乙方逾期交納本合同約定應由乙方負擔的費用,每逾期一天,則應按上述費用總額的0.1%支付甲方滯納金。 3在承包期滿,乙方應如期交還經營場所。乙方逾期歸還,則應向甲方支付雙倍承包金。乙方還應承擔因逾期歸還給甲方造成的損失。 4.承包期未到甲方強行收回場所,甲方當付乙方雙北承包金以及裝修費用。 第十一條爭議解決 甲乙雙方在合同執行過程中發生爭議,雙方應本著友好合同的態度進行協商,若協商不行,則應向承包場所所在地的人民法院提起訴訟。 第十二條本合同雙方簽字蓋章后生效,合同一式二份,甲乙雙方各執一份。 甲方(簽字蓋章) 身份證號: 乙方(簽字): 身份證號: 年 月 日 本文為Word版資料,可以任意修改編輯。如果你看到我上傳的資料這個后綴,請刪除后使用。高效學習方法和技巧學習需要方法,找到適合自己的方法,學習才能事半功倍。接下來,我結合我自己的學習情況,給大家總結的高效學習五部曲一、預習是學習的重要環節上課前充分預習,考試前充分地復習,與“打有準備之仗”有同曲之道。預習效果好,聽課才能有針對性;聽課有針對性,復習才能順利進行;復習深刻,作業、考試才能得心應手。所以說預習是學生學習過程中一個必不可少的環節。二、掌握好高效的聽課方法課上集中精力聽課,是掌握知識的捷徑。聽講時,思想上必須與老師講解的思路保持一致,聽老師對事物是怎樣分析、推理;聽老師解決問題是用什么方法、技巧;聽老師對問題有哪些提問和解釋。這樣才能把握住聽課的重點。聽講中,要把自己在預習中的理解,和老師講解的相比較,看自己和老師有哪些相同點和區別點。三、合理安排復習時間很多科學家通過研究發現,有幾個時間段有利于鞏固記憶:一是學習后最初幾分鐘內,電生理活動引起蛋白質的合成;二是學習后在48小時內復習;三是一周之后腦突觸發生永久性變化。根據人在學習過程中這一生理變化,采用復習加強記憶就顯得特別重要了。如果我們能夠在學習的內容即將忘記時進行復習,那么復習的效果最好,效率也最高。著名的心理學家艾賓浩斯通過實驗發現了人的記憶與遺忘規律。實驗證明:在學習僅過了20分鐘后,就忘記記憶內容的42%,1天后忘卻量已經達到了66%,到了第31天,忘卻量高達79%。他根據實驗結果,畫成了著名的遺忘曲線。并表明遺忘的規律是“先快后慢”。這條規律提示我們,定要盡早、及時地對所學知識進行復習,以便在知識還在大腦內時就加深印記,否則大腦中已經沒有痕跡了,只能再費精力重學。合理安排復習時間特別重要并且必要,制定復習計劃,嚴格按精英特計劃執行,并力求形成習慣,是我們每一位學生都應該力求努力做到。我們為什么要復習呢?因為我們記憶效果沒有那么好,不可能過目不忘,所以需要重復、增強記憶。同時,復習的進展也有利于學習效率的提高。四、做作業的科學方法這里有七種做作業的技巧:1、先復習后做作業。復習是做好作業的關鍵,只有復習得好,作業才能做得好。做作業前先把老師這一節課所講的內容認真地看一看,弄清楚基本原理和概念后再去做作業,作業才能做得既快又好。2、認真審題。 做作業最關鍵的步就是審題,連題都判斷錯了,作業內容就全錯了。首先第步要弄清楚題目的內容,所給的條件,什么要求,需要聯系哪些知識等等;其次是考慮好解題思路、方法、步驟,要善于把道題分成幾部分,化大為小、化難為易、分清其中的已知和未知,弄清各部分的聯系,設計好整個解題步驟,定要讓自己做到不明白題意不做題,不清楚方法步驟不下筆。3、細心的做題。 做題是表達思路的全過程,這個過程要求既動腦、又動手。做題的關鍵是要保證“規范”、“準確”。要做到這兩點就要求學生認真的抄好題,書寫格式必須正確、規范,嚴格按照各類題的解題要求,仔細演算解題的每步,得出正確的結果。只有平時做題認真細致,步驟完整,思路正確,表達嚴密,準確無誤,考試時才能按照這種良好的習慣進行五、重視錯題積累在學習的過程中,同學們可能遇到過一錯再錯的現象究其原因,多數是由于在學習中不求甚解,不注意總結積累所致。那么,該怎么辦呢?實踐證明,自編一本“易錯題集”是避免做題一錯再錯的最好辦法。錯題本的復習方法:1、每周把該周錯題本中記錄的題目快速瀏覽一遍;2、每月把該月錯題本中記錄的題目再快速瀏覽一遍;3、每個季度把錯題本中三個月記錄的題目再快速瀏覽一遍;4、大考前把該錯題本中的所有題目認真復習一遍,確保題不二錯¥精編資料 歡迎下載There are moments in life when you miss someone so much that you just want to pick them from your dreams and hug them for real!
