法律文體的翻譯概述法律文體嚴(yán)謹(jǐn)、正式，采取各種語(yǔ)言手段防止誤解和歧義；其內(nèi)容必須明確，不模棱兩可。在用詞方面，法律文體除了采用專門術(shù)語(yǔ)外，還常用部分古詞、舊詞，特別是here,there,where加上介詞構(gòu)成的復(fù)合副詞，如hereto,herein,hereunder,thereon,thereof,therewith,whereby,wherefore,whereof等。在句法方面，法律文體長(zhǎng)句多，為了達(dá)到嚴(yán)謹(jǐn)無(wú)漏洞的目的，運(yùn)用各種附加語(yǔ)、修飾語(yǔ)和說(shuō)明語(yǔ)，使得句法關(guān)系復(fù)雜化；行文中少用代詞，寧可重復(fù)名詞。現(xiàn)代法律文體主張簡(jiǎn)練、平實(shí)。法律文本的翻譯要求1.用詞精當(dāng)注意同義詞在不同譯文中的差別，保持詞義在上下文中的一致，使語(yǔ)句嚴(yán)謹(jǐn)，例如：Unlessitislegallyorphysicallyimpossible,thecontractorshallexecuteandcompletetheworksandremedythedefectsthereininstrictaccordancewiththecontracttothesatisfactionoftheengineer.除法律或外界條件不允許的情況之外，承包商應(yīng)嚴(yán)格按合同施工和竣工，并改正工作中的任何缺陷，達(dá)到工程師滿意的程度。分析：“physical”在哲學(xué)上與“mental”相對(duì)，表示“物質(zhì)的”、“自然的”。但如果譯為“物質(zhì)的”容易產(chǎn)生歧義，可能與具體的物質(zhì)材料聯(lián)系起來(lái)。這里譯為“外界條件”，即人為以外的條件。
