2017年外教合同(修訂)2017年外教合同(修訂)2017年外教合同(修訂)2017年外教合同(修訂)編制僅供參考審核批準(zhǔn)生效日期地址：電話：傳真:郵編:ContractPartyAHappyMarianKindergartenengagestheserviceofPartyBasanEnglishTeacher.甲方：上海靜安區(qū)民辦格林新蕾幼兒園雇用乙方為英語教師。Theperiodofservicewillbefromthe16thdayofAugustof2017tothe31stdayofJulyof2018.聘雇期2017年8月16日至2018年7月31日。TheworktimeofPartyBwillbeaccordingtotheregulationofPartyAfrom8:00amto4:00pm.AdditionalworkingtimeforPartyBshallbeallocatedbyPartyAinadvance.PartyAhastherighttoadjusttheworkinghoursaccordingtotheneedsoftheschoolbutthetotalworkinghourswillnotbeexceededasstatedinthecontract.乙方依甲方之規(guī)定工作時間為周一至周五上午8時至下午4時整。甲方得依業(yè)務(wù)需求，提前通知乙方加班。甲方在每周總工時不超過本合同議定時數(shù)之原則下，得調(diào)整乙方之工作時段。SalaryThesalaryisCNYwage(beforetax).乙方之薪資為人民幣人民幣（稅前）2.ThesalarywillbepaidtothePartyBonthe10thofeachmonth.Thesalaryiscalculatedfrom1stto30/31stofpreviousmonth..However,ifPartyBtakesleaveofabsenceorifthereareholidaysfor3ormoreconsecutiveworkdaysbeforethepayday,thepaydaywillbedelayedforaperiodequalinnumbertothedaysofabsence.PartyBisrequiredtosignforhis/hersalaryinperson.每月支薪日期為當(dāng)月10日，支薪計算日期為前一個月的1日至30／31日。若乙方在請假或遇支薪日有3日（含）以上的連續(xù)假日，支薪日則予以順延至等同于乙方請假日數(shù)始支付薪資。乙方必須親自簽領(lǐng)薪資。3.PartyAprovides6,000RMBforhousingallowanceeachmonth,PartyBneedstopresentgenuinerenttaxreceiptformonthlyreimbursementbeforethe25theverymonth,orthehousingallowancewillbeaccumulatedtoasthepartofthesalary.甲方提供房租津貼每月6,000元，乙方需提供房屋租賃正規(guī)發(fā)票。乙方需在每月25日之前向甲方提供正規(guī)房屋租賃發(fā)票，逾期將不享受此項津貼。ForeignExpertCertificateandZvisaForeignExpertWorkingpermitand“Z”visaaretheonlylegalworkingpermitdocumentsthatPartyAappliesforPartyB.TheapplicationandhealthexaminationfeeswillbereimbursedbyPartyAafterPartyBsubmitsthereceiptsofapplications.外國人來華工作許可證和Z簽證為甲方為乙方申請的唯一合法工作許可文件。甲方依據(jù)乙方提供的申請費用發(fā)票支付申請和體檢費用。PartyBisresponsibleforprovidingallgenuinedocumentsneededforForeignExpertWorkingpermitandZvisaapplicationinoneweekpriortoallapplicationprocedures.乙方負(fù)責(zé)在申辦程序開始前一周提供真實有效的材料申辦外國人來華工作許可證和Z簽證。3.PartyBmustsupplyPartyAwithalldocumentationneededtoacquireaworkingvisapriortoacceptingtherole.IfavisacannotbeobtainedbecausePartyBhasprovidedfalseinformation,PartyBwillberesponsibleforthefeesofvisaapplicationandhealthexamination.FapiaosmustbeprovidedbyPartyA.若乙方不符合辦理外國人來華工作許可證之資格，乙方需支付所有費用。4.ForeignExpertWorkingpermitshallbekeptbyPartyAandbereturnedtoPartyBastheemploymentends.PartyBhastopayforthefeesifPartyBfailsfinishthecontract,thefeesareamaximumof5,000RMB.FapiaosmustbeprovidedbyPartyA.外國人來華工作許可證由甲方保管，合同期滿歸還乙方。合同期滿前離職，乙方應(yīng)按支付工證件費用。Bonus:Monthlyevaluation,fullattendance,contractfulfillmentbonusPartyBwillreceivemonthlyevaluationbonusofCNY0-CNY800attheendofeachmonthaccordingtohis/herworkattitudeandteachingperformanceevaluatedbytheTeachingDirector.乙方月考核獎金為0~800元，依教學(xué)主管每月考評為發(fā)給標(biāo)準(zhǔn)。PartyBwillreceivefullattendancebonusofCNY200whichwillbedeductedinoneoftheconditionsasfollowing:1）sickleave,2）personalleave,3）anypersonalexcusesforbeinglatenessmorethan2timesinthemonthor,beinglatenessformorethan10minutesononeworkingday,全勤獎金為每月200元。若有一下情況將扣除當(dāng)月全部全勤獎金：1）病假2）事假3）任何個人原因遲到2次以上，或一天遲到超過10分鐘。3.PartyBwillreceiveupmostONEmonthsalary(housingallowanceincluded)as“contractfulfillmentbonus”bytheendthiscontractterm.Theamountofbonuswillbeevaluatedbytheprincipalbasedonworkattitude,attendanceandmonthlyperformance.乙方合同期滿獎金最高一個月工資（含房租津貼）。獎金額度由園長按照年度內(nèi)工作態(tài)度、出勤情況和每月考評核算。Holidays節(jié)假日PartyBwillbegivenallstatutoryholidaysaspaidholidays.ShouldPartyBbeaskedtoworkduringthoseHolidays,he/shewillbecompensatedintheformofextrapaidholidaystotakeatatimemutuallyagreeduponbybothparties.國定假日為支薪假日。乙方依甲方要求在國定假日工作，且雙方均達(dá)成協(xié)議情況下，甲方需支付加班費用。Paidvacationwillbearrangedduringwinterandsummerbreaksbasedonschoolcalendararrangedbykindergartenprincipal.Theestimatepaidholidayswillbe8daysinwinterbreak,15daysinsummerbreak.支薪假期由甲方依照校歷安排在寒暑假。預(yù)定8天于寒假，15天于暑假。Unpaidholidayscanbearrangedduringwinterandsummerbreaksbasedonschoolcalendararrangedbykindergartenprincipal.Theestimateunpaidholidayswillbe5daysinwinterbreak,5daysinsummerbreak.不支薪假期由甲方依照校歷安排在寒暑假。預(yù)定5天于寒假，5天于暑假。Besideswinterandsummerbreaks,alldaysoffwillbeconsideredaspersonalleaveswhichwillleadtosalarydeductionfortheexpendituretosubstituteteachers.乙方除寒暑假期外的請假均以事假處理，以扣減薪資支付代課教師費用。IncaseofabsencefromworkwithoutPartyA’spermission,3days’salarywillbedeductedforeachabsentdayunlessadoctor’snotecanbeprovided.Forseriouscircumstances,PartyAhastherighttoterminatethecontractimmediately.請假未獲批準(zhǔn)而仍未到職，視為曠職，每曠職1天，扣除3天工資。若情節(jié)重大，經(jīng)查屬實，甲方得立即解除合同。Insurance保險MedicalInsuranceplanisofferedbypartyAwhichwillbebasedoninsuranceagencyarrangement.甲方依據(jù)保險公司提供的方案為乙方提供醫(yī)療保險。Bothparties’obligations雙方之義務(wù)PartyAshallintroducetoPartyBthelaws,decreesandrelevantregulationenactedbyChinesegovernmentandshallnotinterfereinChina’sinternalaffairs.甲方應(yīng)告知乙方遵守中國政府法律規(guī)章且不得干涉中國內(nèi)政。PartyBshallobservePartyA’sworksystemandregulationsandshallacceptPartyA’sarrangement,direction,supervisionandevaluationinregardtohis/herwork.WithoutPartyA’sconsent,PartyBshallnotrenderserviceelsewhereorholdconcurrentlyanypostunrelatedtotheworkagreedonwithPartyA.乙方應(yīng)依甲方之指示遵守公司工作規(guī)范及指導(dǎo)。未經(jīng)甲方書面同意，乙方不得同時于其他公司任職或執(zhí)行與甲方業(yè)務(wù)無關(guān)之工作。PartyBshallcompletethetasksagreedonscheduleandguaranteethequalityofwork.乙方應(yīng)善盡職責(zé)及保證工作質(zhì)量。PartyBshallrespectChina’sreligiouspolicy,andshallnotconductreligiousactivitiesincompatiblewiththestatusofateacher.乙方應(yīng)遵守中國宗教政策，且不得以教師之身份進(jìn)行宗教活動。PartyBshallrespecttheChinesepeople’smoralstandardsandcustoms.乙方應(yīng)尊重中國人民之道德標(biāo)準(zhǔn)與習(xí)俗。Theregulationsstatedinappendixtothiscontractactasequalliabilityasthecontractitself.本合同附件所列之工作規(guī)范與合同本文同樣有效。Revision,Cancellation,TerminationandRenewaloftheContractBothpartiesshouldabidebythecontractandshouldrefrainfromrevising,canceling,orterminatingthecontractwithoutmutualconsent.甲乙雙方遵守合同規(guī)范，未經(jīng)雙方書面同意，不得自行修改，取消或終止本合同。PartyAhastherighttocancelthecontractimmediatelywith30dayswrittennoticetoPartyBunderthefollowingconditions:甲方得提前30日用書面通知乙方立即終止合同，若乙方有下列情事發(fā)生：PartyBdoesnotfulfillthecontractordoesnotfulfillthecontractobligationsaccordingtothetermsstipulated,andhasfailedtoamendafterPartyAhasprovidedawrittenandverbalwarning.乙方未依合同內(nèi)容履行工作且經(jīng)甲方糾正仍拒不改正。Accordingtothedoctor’sdiagnosis,PartyBcannotresumenormalworkafteracontinued30dayssickleave.依據(jù)醫(yī)師診斷，乙方在連續(xù)病假30日后仍無法正常工作PartyBisabsentwithoutrequestmorethantwiceduringthedesignatedcontract.合同期間，乙方請假未經(jīng)核準(zhǔn)而曠職2次以上。PartyBisfoundtraffickinginanytimeduringhis/herworkperiodorisintoxicated.乙方有販毒或吸食毒品之行為。PartyBisundertheinfluenceofillegalsubstancesorposesriskofsafetytotheworkingenvironment.乙方持有非法物品或所做出危及工作場所安全之行為。PartyBhasfailedtofollowanyoftheregulationsofthiscontractandtomaintainprofessionalconductuntilhis/hercontractexpiresorcomplete.乙方無法依合同規(guī)范及執(zhí)行工作項目。IfPartyBhasfailedtomaintainandimprovehis/herworkingattitude,failedtoactupondirectives,andfailedtoimprovehis/herperformanceorothermisconduct(s).ThedismissalwillbeinstantforreceivingthethirdwarningnoteissuedbyPartyA.若乙方無法持續(xù)及改進(jìn)其工作態(tài)度，或不依甲方之指正改善其表現(xiàn)及行為不當(dāng)，在收到甲方三張警告單時，得立即解雇乙方PartyBfailstoprovidegenuinedocumentsasPartyArequestsforForeignExpertWorkingpermitand“Z”visaapplicationinonemonth,thiscontractwillbeterminatedautomatically.PartyBshallpayfortheallthefeesthathasbeensubsidizedbyPartyAifthedocumentsarenotprovidepriortosigningthecontract..乙方在合同簽訂后一個月內(nèi)無法提供辦理外國人來華工作許可證和Z簽證之有效文件，本合同即自動失效。乙方需支付甲方代墊之各項費用。PartyAreservestherighttoterminatethiscontractintheeventofincompetenceorviolationsagainsttheemploymentregulationsbyPartyB.30days’advancednoticeisrequiredifPartyAmustterminatethecontract.甲方保有因乙方工作不力或違反合同規(guī)范而解雇乙方之權(quán)利。若需提前解約，甲方需提前30日通知乙方。ThiscontractwillbeconsideredtobeterminatedifthenumberofstudentsofPartyBdecreasedmorethan1/3becauseofadirectresultoftheteacherspoorteaching..當(dāng)乙方之學(xué)生人數(shù)減少三分之一時，甲方得考慮解除合同。PartyBisrequiredtofulfillthiscontract.His/HerfailuretodosoforanyreasonwillresultinacompensationforCNY3000.30days’advancednoticeisrequiredifPartyBmustleavethepost.Formofnoticeunder30dayswillresultinanadditionalpenaltyofCNY3000;however,advancednoticeover30days’willnotresultincompensation.Duringthis30days’advancednoticeperiod,PartyBshallstillperformhis/herdutiesasspecifiedinthecontract.His/HerfailuretodosowillresultinanotherpenaltyofCNY3000.Intheeventofdismissal,PartyBwillreceivehis/herwageuptobutnotincludingtheworkingdayofdismissal,excludingallapplicablepenalties.乙方因故未能履行合同期滿，應(yīng)支付甲方CNY3,000作為違約賠償金。若乙方因故主動提解約，少于30日之告知期，乙方需再支付甲方CNY3,000罰金，提前30日以上告知則免罰。在離職前，乙方仍應(yīng)依合同規(guī)范內(nèi)容工作，否則甲方得以另罰CNY3,000元。解約同時，乙方會收到扣除賠償金及罰金之薪資。Therenewalofthecontracteveryyearwillbebasedupontheteachingperformance,workingattitude,seniority,andannualevaluationofPartyBandonthestudentre-enrollmentrateconcerningtheteacher.Theappendixofthiscontractisaninseparablepartofthecontractandhasequaleffect.Thiscontracttakeseffectonthedatesignedbybothpartiesandwillautomaticallyexpirewhenthecontractends.Ifeitherofthetwopartiesasksforanewcontract,itshouldforwarditsrequesttoanotherparty90dayspriortotheexpirationofthecontract,andsignthenewcontractwithmutualconsent.合同期滿續(xù)約將視乙方之教學(xué)表現(xiàn)、工作態(tài)度、年資、年度考評及學(xué)生續(xù)班率而定。本合同附件其效力與合同相同不得分割。本合同自雙方簽訂之日起生效，期滿自動終止。任何一方欲續(xù)約，應(yīng)于合同屆滿前90日提出，并由雙方簽訂新合同完成續(xù)約程序。ArbitrationThetwopartiesshallconsultwitheachotherandmediateanydisputeswhichmayariseaboutthecontract.Ifallattemptsfail,thetwopartiescanappealtotheorganizationofarbitrationforforeignexperts’affairsintheStateAdministrationofForeignExpertsAffairsandaskforafinalarbitration.相關(guān)因本合同產(chǎn)生之爭議，應(yīng)由雙方調(diào)解處理之。若無法調(diào)解，雙方得聲請外國專家局為仲裁機(jī)關(guān)。ThisContractissignedatHappyMarianXinleiKindergarten,JinganDistrict,Shanghai,China,induplicate.本合同一式兩份簽訂于上海靜安區(qū)民辦格林新蕾幼兒園ThiscontractiswritteninChineseandEnglish,onlytheEnglishtextislegallybinding.本合同以中英語書寫，以英語內(nèi)容為準(zhǔn)PartyA:上海靜安區(qū)民辦格林新蕾幼兒園（HappyMarianXinleiKindergarten）Signature:____________________Contact:PartyB:_______________Signature:____________________Address:______________________Identification:__________________DateofSigned:________________________THEAPPENDIXJobDescription工作內(nèi)容Teachingandcaringforthechildren.教學(xué)及照顧兒童PartyBisrequiredtoattendandsupportallactivitiesheldbyPartyA.Theseincludeallopenhousegatherings,morningexercises,performances,PTAmeetings,teachers’meetingsandteachers’trainingand,otherteaching-relatedtasksassignedbytheTeachingDirector.乙方應(yīng)參與及支持甲方舉行之所有活動，包括：校園參觀日，晨間活動，學(xué)生表演，家長會，教師會議及培訓(xùn)等。其他由教學(xué)主管指派與教學(xué)相關(guān)的活動Assistinginthemarketingworkifnecessary.在必要時協(xié)助招生活動。Regulations,RulesandworkObligationsPartBisrequiredtosigninandoutforworkontime.Every5minutes’latenesswillresultinaCNY25reduction.Thisreductionwillbedoubledifsuchasituationoccurs2ormoretimesduringamonth.Beinglatefor30minsormorewillbeconsideredasanhourabsenceandmorethananhourwillresultinareductioninsalarytheequivalentof2hourscompensationforeverysinglehour.乙方上下班均應(yīng)打卡。每遲到5分鐘，扣人民幣25元。當(dāng)月第2次以后遲到，每5鐘扣人民幣50元。遲到30分鐘以上，視同缺勤，扣除2小時時薪。PartyBshallfollowthetimetablethatarrangedbythekindergartenprincipal,seeattachment1.乙方應(yīng)依幼兒園園長安排之時間表執(zhí)行工作，如附件一。Teacher’sweeklyevaluationformisconsideredasaformalworkingrecordduringthecontractterm,seeattachment2.乙方之周教學(xué)考核將視為正式考評記錄之一，考評表如附件二。By8:00,allfacultyshouldbeattheirownclassroomsandstartthemorningactivity.Allpersonalactivityshouldbefinishedbefore8:00.eatingbreakfast.上午8：00所有教職員均應(yīng)進(jìn)教室開始晨間活動。所有個人的活動，如吃早餐，都必需在8：00前完成。Staffofficeisopenedtoteachersforclasspreparationduring13:30to14:15.教師辦公室僅于13：30~14：15開放供教師備課使用。PartyBwillnotdiscloseinformationconcerningtheworkcontentwithoutthewrittenpermissionofPartyA.乙方未獲甲方書面許可，不得向他人透露工作內(nèi)容。PartyBisrequiredtofollowtheteacher’sguideandtheteachingplanswhichhis/hershouldfamiliarizehim/herselfwithbeforeclass,andifnecessary,notesmaybeusedduringthelesson.Beingfoundreadingthelessonplaninclassornotfollowingthelessonplanwillresultinaforfeitureofanhour’swageforthatclass.ChangestothelessonplanmayonlybemadeafterconsultationwiththeTeacher’sdirectorOR,PartyBwillfacepenaltyofwagedeductionatCNY200/class.乙方應(yīng)依教師手冊及教學(xué)計劃執(zhí)行教學(xué)工作，并應(yīng)完成課前準(zhǔn)備，熟悉教學(xué)內(nèi)容及步驟。不按規(guī)范教學(xué)，扣除當(dāng)節(jié)鐘點費。未經(jīng)教學(xué)主管同意，擅自更改教學(xué)計劃罰薪人民幣200元。PartyBisrequiredtodesigncurriculumplantwoweeksbeforeandgiveittotheTeacherDirectorontimeOR,PartyBwillfacepenaltyofwagedeductionatCNY200/week.乙方未提前二周繳交教學(xué)計劃，罰薪人民幣200元。PartyBisnotallowedtoengageinsellingofanyproductsorservicestotheparentsorstaffofPartyA.乙方不得對學(xué)生/家長/同事及甲方進(jìn)行銷售任何產(chǎn)品及服務(wù)。PartyBisnotallowedtoprovideanytutoringservicetothechildrenorfamiliesattendingPartyAschool.乙方不得對甲方在校學(xué)生及家人進(jìn)行課后家教補習(xí)。Thecopyrightofanyactivityplansortapeswritten/madebyPartyBduringtheworkingtimebelongtoPartyA.乙方于上班時間任何教學(xué)活動之著作或錄音等版權(quán)歸甲方所有。PartyBisrequiredtoupholdtheConfidentialityofallaspectsofPartyA.Theentirelessonplans,documentsandresourcesarecommercialintellectualpropertiesofPartyAandprotectedbylaw,LegalproceedingwillbetakenagainstPartyBifhe/sheusesoroffersanyoneanypartoftheabove-mentionedsoftwareorintellectualpropertyanywherebeyondtheschoolofPartA.乙方應(yīng)保守甲方所有業(yè)務(wù)相關(guān)之機(jī)密。教學(xué)計劃，文件及資源均視為甲方之商業(yè)智慧財產(chǎn)并受法律所保障。在甲方以外之任何地點使用上述任何一項，均將面臨法律追訴。PartyBisrequiredtoupholdallPartyA’spropertiessuchasbooks,teacher’sguide,lessonplan,computer,laptops…AnydamageorlosswhichcanbeleadtothePartyB’sresponsibilitywillresultinequivalentcompensationoftheproperty(forexample,foreachHappyMarianlessonplan,CNY1,000).乙方應(yīng)妥善保管甲方之所有財物例如：書籍，教師手冊，教學(xué)計劃，電腦，筆記本電腦。若有可歸咎于乙方之使用而造成損壞或遺失，應(yīng)照價賠償。PartyBshouldkeepconfidentialoftheinformationrelatedtowageandmustnotenterintodiscussionsaboutthisinformation.PartyAhastherighttoterminatethecontractandinvestigatetheliabilityoftheemployedpartyforviolation.乙方不得向任何甲方以外之第3方談及薪資待遇等信息。經(jīng)查證屬實，乙方具有違約之事實，甲方得解除乙方合同。PartyBshouldsetagoodexampleforcolleagueswhilstprotectingthecompanyandtheschools’reputationandimage.乙方應(yīng)為同僚行為模范并保護(hù)公司及學(xué)校名譽與形象。PartyBmustabidebyalllawsandregulationoftheGovernmentofatalltime.乙方隨時應(yīng)遵守中華人民共和國之法律及規(guī)章。PartyBisrequiredtowatchandinteractwithstudentsduringplaytime.Duetosafetyconcernshe/sheisnotallowedtotakerecessorspendtimechattingtootherteachers.乙方應(yīng)在學(xué)生游戲時間與學(xué)生互動參與游戲。依安全考慮，游戲期間，乙方不得與其他同事閑聊而置學(xué)生不顧PartyBshouldbedressingdecentandpresentableasaschoolteacherwhomaynotwearingsunglasses,sandalsnorslippers,singlet,nailpolish.Maleteachershouldbeshorthaircut,nobeard,noearrings.乙方在工作時間要注意儀表端莊，在校內(nèi)不可以戴墨鏡、穿拖鞋、吊帶衫并涂深色指甲油。男教師需短發(fā)、每天刮胡須、不戴耳環(huán)。PartyBisrequiredtocompletecommunicationbookandBiweeklyReportforeachstudent.ThereportmustbehandedintotheteachingdirectoreveryWednesdayand,Thursdayofeveryalternateweek.FailuretohandthereportinontimewillresultinafineofCNY100.乙方應(yīng)填寫家聯(lián)本及雙周學(xué)習(xí)報告，并于每周三及隔周周四交予教學(xué)主管，否則罰薪人民幣100元。Brainstormingforlessonplansandpreparationforclass(suchasapplyingformaterials)shouldbedone2weeksaheadoftime.PartyBisrequiredtopreparetheteachingmaterialsforeachweek’slesson.Failuretopreparetheteachingmaterialsorpreparingthematerialsduringhis/
