2、accordence to the provisions of people，s republic of china law of contract, parties hereto conelude and inter into this contract on the party b" s sale and installment of computer to party a for observance of parties hereto.一、乙方售出的電腦應通過專業人員測試，符合國家產品質量法、 標準化法相關規定，器材于售出前都在設備的特定位置貼有保修封 條。all compu

3、ters sold by party b are tested by professional and conform to the related prescriptions of law of product quality and law of standardization. prior to sale of computer and other equipments the maintenance seal shall gluded on the special place on sold equipment.二、售出的器材，都由乙方專業人員傳授器材的使用方法，必要時并 作適當的技術

4、培訓。the application method with the sold equipments shall be provided by par ty b s professi on al. at any necessary appropria te technical training shall be made for party a.三、所有器材口售出即fl起，一年內由器材本身質量所產生的故障， 將實行：any failure or malfunction due to equipment" s itself from and on the date of selling

5、 will be treated by ways as below:1、三個丿 j 保換；exchange same model produc t wit hin t hree mon ths from the date of selling.2、三年內免費保修；maintenance free of charge within three years form the date of selling;四、從系統驗收后起，三個月的保用期內，若因設備本身質量問題發 生故障，乙方予以更換同型號新產品；where any failure or malfunction of equipment&quo

6、t; s quality arise within three months from and on the date of check and acceptance of equipment system by party a, party b shall replace new product of same model.五、保修期為三年。此期間，乙方履行無償維護服務。于接到用戶故 障后，即時派專業人員到場；guarranty period is three years, within which party b shall provide maintenance service free

7、 of charge to party a and send professional to the scene as soon as possible upon receiving party a' s trouble notice-六、發生如下因素z-，所造成的損失故障，不屬保用、保修范圍， 乙方恕不負任何經濟責任：the loss / malfunction being produced or due to one of factors or couscs below is not within maintenance and warranty, and no any econo

8、mical responsibility borne by party b.1、非屬乙方z專業維修人員或工程人員撕毀保修封條,拆開機器的; not specialty of serviceman or the projeet personnel of our company tears maintains seal, disassembles the machine;2、火災，電擊、外界物體倒塌或其它自然災害所導致的設備損壞； fire,electric shock, outside object collapse or other natural disasters causes make

9、the equipment damage.3、非乙方職工或非乙方授權使用者使用，或使用權用者進行操作造成 的人為故障；failure or malfunction due to non- party b staff or non-user authrized by party b or man-made by outhrized operator.七、乙方出售并施工安裝的器材于工程驗收后，都必須建檔，并填寫“設備備案卡” o以后器材的維修運行情況都應填入此卡；card of equipment record should be filled in after the acceptance of

14、甲方驗收合格z日起按生產廠家保修標準執行； maintenance standard executcd by party b shall be according to manufacturer" s maintenance standard as of the date of acceptance by party a.3、保修及維護方式：乙方對提供的設備提供三年的免費維護服務（若 硬件出現故障，不能及時解決，乙方需及時提供同型號產品臨時代用）。 當甲方發生設備故障并以電話或書而方式通知乙方時，乙方應該在6個 工作時到達故障現場。maintenance and its servic

17、med to party b by telephone within seven days for settlement or replacement, otherwise it shall be deemed to be qualified through acceptance of tcst.2、甲方不能拖欠乙方所有費用，如果違約，需向乙方支付違約金（總 合同金額）0. 1%/天。party a cannot defauit payment due to party b, if breach of payment clause herein, should pay the penalty

18、to the party b at rate of 0. 1%/day on base of total contract amount.十二、違約責任：responsibility of breach1、乙方不能按合同約定時間交貨，屬違約行為；甲方不能按合同規 定限期支付貨款，屬違約行為。違約方需向對方支付違約金，罰 款總額不超過合同價款的0. 1%owhere party b cannot effect the delivery of goods accord to the agreed time of this contract, which is breach of contract

19、and where party a fail to effect the payment within time limit to party b which is breach of contract. breach party should pay penalty to opposite party, total amount of penalty is not exceeding 0. 1% of totai contract amount.2、解決合同糾紛的方式：本合同發生糾紛，經雙方協商或調解不成， 任何一方有權向人民法院提起訴訟。all disputes arising in connection with this contract or in the execu tion thereof should be set tied arnica bly through negotiatinns. in case no settlement can be reached, the case in dispute shall then be submitted by any party to court for litigation.其它：other:十三、其他約定1、維護期滿，甲乙雙方另行簽訂維護合同，延續服務條款。upon cxpiratio
