如何查詢美國專利一.專利用處

發明人最不想遇到的狀況莫過于花費許多時間與精力將自己新的構想付諸實現后，才發現同樣的發明早已有人做過。避免這種狀況的最好辦法，就是在研發初期做好信息收集的工作。根據國際經濟暨發展組織（OrganizationforEconomicCooperationandDevelopment：OECD）的統計結果，有百分之八十以上的科技知識被描述在專利文件中，而大部分被描述在專利中的技術并沒有被記載在其它的發行刊物。因此，發明人絕不可忽視專利信息的重要性。什么是專利信息？提到專利，一般人會認為專利只是一個保護產品的法律權利。事實上，除了可以保護產品外，專利也像是產品的使用手冊，有文字及圖標敘述產品的組件、特征、用途，以及使用方法。此外，專利信息還包括任何可以從專利局發行的文件中所獲得的信息，包括技術資料、市場信息、法律信息、以及公司的任何信息。二.專利主要內容

一）封面：包括專利的基本資料﹙如專利號碼、專利申請日、發明人姓名等﹚和發明摘要。

封面：封面提供專利的基本資料，在每一筆基本資料旁都印有以[]框起來的號碼，也就是大家熟知的INID碼（InternationallyagreedNumbersfortheIdentificationofBibliographicDatacode；INIDcode）。每個INID碼各代表不同的數據項，例如[54]代表發明名稱，[76]代表發明人姓名與戶籍地。由于INID碼是國際統一的號碼，因此各國的專利都是以[54]來表示發明名稱。封面上還包括摘要，對發明作簡單描述，在摘要下方還會指出專利所包括的請求項與圖標張數。另外，封面還可能包括專利的代表圖標。以下是美國專利中常見INID碼及代表的意義：[19]公告的國家或組織：出現在2001年1月2日前公告的美國專利中，顯示在專利封面左上角的UnitedStatesPatent右方，位于下方的英文為第一發明人的姓。[12]公告型態：出現在2001年1月2日后公告的美國專利中，會顯示UnitedStatesPatent，位于下方的英文為第一發明人的姓。[11]專利號碼：出現在2001年1月2日前公告的美國專利中，不同的專利種類有不同格式的專利號碼。舉例來說，「發明專利」的專利號碼為純數字的序號，如6,666,666。「新式樣專利」的專利號碼以字母D開頭（D表示Design）后加數字序號，如D333,333。「植物專利」的專利號碼以PP開頭后加數字序號，如PP8,112。[10]專利識別碼：出現在2001年1月2日后公告的美國專利中，舉例來說，US6,541,321B1代表美國發明專利第6,541,321號，其中的B1表示專利在獲準前并沒有被早期公開過。在美國采用早期公開制度后，2000年11月29日后申請的案件在提出申請后一段時間（通常為18個月），美國專利局即公開專利申請案的內容†，這類的專利識別碼會以B2做結尾。[45]專利公告日：專利公告的日期。[54]發明名稱：專利申請人對發明的命名。[75]發明人資料：包括發明人姓名，以及發明人的戶籍地。用于當發明人為申請人但不為專利權人時。[76]發明人資料：包括發明人姓名，以及發明人的戶籍地。用于當發明人同時為申請人及專利權人時。[73]專利權受讓人：專利權的擁有人，通常為發明人的任職公司。[21]專利申請案號：專利提出申請時，美國專利局給予的申請號碼。[22]專利申請日：專利申請的日期。[63]專利的母案及其相關信息：當專利為延續案時，其所依據的母案資料。[51]國際專利分類號：代表發明所屬的發明類別。[52]美國專利分類號：代表發明所屬的發明類別。[58]檢索范圍：為審查委員在審查時，檢索過的專利所屬的美國專利分類號。[56]引證案：為審查委員在進行專利審查時所參考過的相關資料，包括美國專利文件（U.S.PatentDocuments）、外國專利文件（ForeignPatentDocuments）與其它刊物（OtherPublication）。[74]代理人資料：提供代理人的姓名或代理律師事務所的名稱。[57]發明摘要：為發明的簡單描述。

二）圖標：包括描繪發明的圖標。

圖標：專利中常會以圖標來協助讀者了解發明，圖式中會對不同的組件標示號碼，方便在文字部分作說明。此外，圖標對英文非母語的讀者也有很大的幫助，對于簡單的發明，常常可以用看圖說故事的方式了解發明的內容。在美國專利中，習知技術的圖標會標示PriorArt，反之沒有標示PriorArt的圖標為發明的圖標，讀者常常可以藉由比較習知技術與新發明的圖標，了解發明的特征。•發明名稱：同于專利封面上所印的發明名稱。•發明領域（FieldoftheInvention）：簡短描述發明所屬的技術領域。•習知技術（DeionoftheRelatedArt或DeionofPriorArt）：描述習知技術的缺點以及有待解決的問題。•發明總覽（SummaryoftheInvention）：概括地描述申請專利的發明以及其優點。•各圖標的簡單說明（BriefDeionoftheDrawings）：對每一圖標做簡短的說明。•發明的詳細說明或較佳實施例的詳細說明（DetailedDeionoftheInvention或DetailedDeionofthePreferredEmbodiments）：以文字詳細敘述發明的內容與特征，為專利中描述發明的最主要地方。通常會利用發明的例子（實施例）來協助說明

三）說明書的內容部分：包括文字描述。

四）申請專利范圍：包括請求項（或稱權利項）定義專利的保護范圍。

申請專利范圍：申請專利范圍的部分包括一個以上的請求項，各請求項以阿拉伯數字依序編號，站在法律的角度，請求項是專利中最重要的部分。請求項是專利中用來界定專利保護范圍的地方，也是用來判斷是否侵權的指針。請求項由三部份所組成：前言（preamble）、連接詞（transitionalphrase）與主體（body）。依序說明如下：•前言：為發明的名稱，有時還包括發明使用的環境或條件。•連接詞：緊接在前言之后，用來導引出主體部分。常見的連接詞有comprising（包括）、consistingof（僅包括）、和consistingessentiallyof（主要包括）。連接詞的選擇影響專利保護范圍甚大，不同的連接詞會界定出不同的保護范圍。舉例來說，「comprising」表示專利不僅保護包括在請求項中所有的構件（組件或步驟），任何東西只要包括請求項中所有的構件，不管是否還包括其它未在請求項中出現的構件，都構成侵權；「consistingof」則表示專利僅保護包括在請求項中的構件，當有東西還包括其它未在出現在請求項的構件時，則不構成侵權；「consistingessentiallyof」常見于醫藥類的專利，用來表示專利保護包括在請求項中所有的構件以及其它不改變發明特性的構件，如果其它藥物成分另外含有添加物會改變專利保護成分的特性，則不構成侵權。常見的請求項分為獨立項（IndependentClaim）與依附項（DependentClaim）。獨立項主要用來單獨界定較廣的保護范圍，包括發明的一些基本構件。不同于獨立項可以單獨界定保護范圍，依附項必須依附在其它請求項上，其保護范圍包括所依附的請求項中的構件以及其本身的構件，進一步縮小所依附的請求項的保護范圍三.如何使用專利信息

參考專利信息來規劃研究方向：發明人可藉由專利信息取得技術協助，解決技術瓶頸。并藉由專利信息可以啟發研究靈感，避免重復研發或侵犯已取得專利的發明技術。專利信息中同時包含專利權人的資料，可作為發明人日后考慮合作對象的參考。藉由專利信息來追蹤競爭對手的研發進展：發明人可利用專利信息了解競爭對手在相關領域的研究成果以及在市場上的規劃。舉例來說，藉由獲得對方尚在申請的專利案資料，可以預測競爭對手可能推出的產品；藉由獲得對方放棄的專利案資料，可以預測競爭對手可能放棄生產的產品；藉由獲得對方相關領域發明人的資料，可以知道競爭對手所投入的人力資源；藉由了解對方在哪些國家申請專利，可獲得競爭對手的市場規劃。利用專利信息來了解技術發展的趨勢：藉由分析專利信息，發明人可了解不同國家的產業結構與技術趨勢，進而擬定市場策略的依據四如何查詢美國專利

二十年前，大部分專利資料收集的工作都是以雇用人工的方式，在收藏專利的圖書館中進行。在專利資料計算機化與網絡普及后，許多主要的專利局都已在網絡上提供免費的專利信息服務。以下將以美國專利局為例，說明如何利用網絡資源進行專利資料的收集。美國專利局(提供1790年至今的美國專利以及2001年后的早期公開申請案的線上查詢。其中，1790到1975年的專利由于只有圖像文件（TIFF格式文件），因此只提供專利號碼與美國專利分類號的檢索。在進入美國專利局的網站后，點選左邊一欄Patents下的Search：接著，使用者會進入PatentFull-TextandFullDatabases的畫面：畫面上綠色區域屬于獲準專利（IssuedPatents），黃色區域屬于申請案的早期公開資料（PatentPublications），兩區域各有快速檢索（QuickSearch或BooleanSearch）、進階搜尋（AdvancedSearch或ManualSearch）、以及專利號碼檢索（PatentNumberSearch）三種搜尋的方式。快速檢索：使用者可以輸入單一兩個關鍵詞組合（如AND、OR、和ANDNOT的組合）進行檢索，同時可指定關鍵詞所出現的字段（如標題、發明摘要、發明人姓名等）與專利公告的年份。例如，要搜尋「專利權人」為MicrosoftCorporation（微軟軟件公司），「發明名稱」為searchengine（搜尋引擎），從1976年到現在的專利，則將檢索條件設定如下：搜尋結果如下：點選欲閱讀的專利，如美國專利第6,523,021號則會顯示專利的文字內容。如下所示：要注意的是，這部分只顯示專利文件的文字部分，并不包括圖標。如果使用者對圖標有興趣，可以點選「Images」閱覽專利的TIFF圖片文件，如下所示。若欲閱覽專利的下頁，可按下專利左上角「GotoPage」下方的箭頭，進入下一頁；進階搜尋：使用者可以輸入多個關鍵詞，并以代號指定關鍵詞出現的字段進行檢索。例如：要搜尋「專利名稱」為camera（相機），「專利權人」為Sony（新力），「專利權人所位于城市」為Tokyo（東京），從1976年到現在的專利，則需要鍵入搜尋條件「TTL/cameraandAN/sonyandAC/tokyo」并選擇年份「1976topresent」，如下：進階搜尋：使用者可以輸入多個關鍵詞，并以代號指定關鍵詞出現的字段進行檢索。例如：要搜尋「專利名稱」為camera（相機），「專利權人」為Sony（新力），「專利權人所位于城市」為Tokyo（東京），從1976年到現在的專利，則需要鍵入搜尋條件「TTL/cameraandAN/sonyandAC/tokyo」并選擇年份「1976topresent」，如下：專利號碼檢索：利用專利號碼或專利申請案的公開號碼搜尋進行檢索。關鍵詞檢索可說是一般使用者最常用的檢索方式，但是這種方式容易遺漏掉某些專利。另一種比較常見的方法，是利用美國專利分類號來做檢索。美國專利分類號給予各技術類別技術不同的分類號碼，有系統的將專利依技術類別分類。利用分類號檢索，可取得較完整的專利資料。檢索的方式有兩種，一種是以關鍵詞找出一些專利后，再利用這些專利鎖列舉的專利分類號在QuickSearch內進行一次全面的檢索。另一種方式是利用美國專利局的專利分類號數據庫找出相關技術的分類號，再利用這些分類號做檢索。專利局還提供利用關鍵詞找出專利分類號的功能，網址位于_blank"By」可連結至參考過本篇專利的其它專利‡美國專利分類號美國專利分類號有系統的將專利申請案依照技術類別分類，并賦予不同技術類別不同的專利分類號。分類號的格式為「大分類號/小分類號」，其中大分類號代表的是主要的技術分類，小分類號代表的是每個主要技術分類下更細小的分類。以368/28為例，368代表的是量測時間的系統或組件，28代表的是具有顯示日期功能的組件。美國專利局有提供各美國專利分類碼所代表類別的線上查詢，網址為：_blank"（一）利用專利或公開申請案所提供的資料。每一個專利或公開申請案的封面上都會印有該發明所屬的美國專利分類號，因此可藉由找出特定發明的專利或公開申請案得知該發明的專利分類號。請參考「專利封面導讀」。（二）利用關鍵詞來檢索。例如，要知道手表（Watch）的分類號，可在進入_blank";后，點選網頁中的字母「W」，如下所示：之后網頁會顯示所有以W字母開頭的技術類別及其分類號，使用者可以依字母順序找到Watch所屬的分類號，如下所示：另外，也可利用輸入關鍵詞的方式來檢索，但由于檢索出來的資料比較復雜，建議還是使用上面點選字母的方式會比較容易。（三）利用瀏覽的方式尋找。美國專利局有將大分類號與其對應技術類別的描述，依大分類號的順序列在網頁內，網址是_blank"Search）網頁，輸入美國專利分類號，進行專利檢索。例如要檢索「美國專利分類號」為368/28，從1976年到現在的專利，則可以將檢索條件設定如下:在term1中輸入368/28，下拉菜單中選中currentUSclassification點research
