P.SOLBES共20頁(yè)第5頁(yè)歐洲共同體公報(bào)第4條1.從1990年6月1日生效之日起，成員國(guó)：—不可再對(duì)側(cè)向保護(hù)裝置不滿足本指令要求的車(chē)輛型式發(fā)布指令70/156/EEC第10條（1）第三行中給出的文件，—可以拒絕為限側(cè)向保護(hù)裝置不符合本指令規(guī)定的車(chē)輛類(lèi)型發(fā)放國(guó)內(nèi)型式認(rèn)證。2.從1991年5月1日生效之日起，成員國(guó)可以禁止側(cè)向保護(hù)裝置不符合本指令要求的車(chē)輛首次投入運(yùn)營(yíng)。第5條委員會(huì)應(yīng)該按照指令70/156/EEC第13條中的流程來(lái)采用針以便本指令技術(shù)進(jìn)展的附錄要求而做出的必要修正。第6條1.成員國(guó)應(yīng)該執(zhí)行必要條例以便從1989年10月30日其執(zhí)行該指令。并應(yīng)進(jìn)一步通知委員會(huì)。2.成員國(guó)應(yīng)該就采用的涵蓋本指令的本國(guó)法的主要規(guī)定與委員會(huì)進(jìn)行溝通。第7條本指令通過(guò)寄送方式發(fā)給各成員國(guó)。在盧森堡制訂，1989.年4月13日 P.SOLBES共20頁(yè)第6頁(yè)OffcialJounaloftheEuropeanCommunitiesANNEXTECHNICALREQUIREMENTSFORLATERALPROTECTION1.Generalprescriptionsanddefinitions1.1.EveryvehicleofcategoriesN2,N3,O3andO4shallbesoconstructedand/orequippedastooffer,whenacompleteentity,effectiveprotectiontounprotectedroadusers(pedestrians,cyclists,motorcyclists)againsttheriskoffallingunderthesidesofthevehicleandbeingcaughtunderthewheels(1).TheDirectivedoesnotapplyto:—tractorsforsemi-trailers,—trailersspeciallydesignedandconstructedforthecarriageofverylongloadsofindivisiblelength,suchastimber,steelbars,etc.,—vehiclesdesignedandconstructedforspecialpurposeswhereitisnotpossible,forpracticalreasons,tofitsuchlateralprotection.1.2.Avehicleshallbedeemedtosatisfytherequirementsetoutinpoint1.1ifitssidepartsprovideprotectionconformingtotheprovisionsoftheparagraphsbelow.1.3.Definitions1.3.1.VehicletypeforthepurposesoflateralprotectionTheterm'vehicletypeforthepurposesoflateralprotection'meansvehicleswhichdonotdifferwithrespecttothefollowingmaincharacteristics:widthoftherearaxle,structure,dimensions,shapeandmaterialsofthebodyworkandchassis,characteristicsofthesuspensionofthevehicleinsofarastheyhaveabearingontherequirementsofpoint,'Unladenmass'meanstheweightofthevehicleinrunningorder,unoccupiedandunladenbutcompletewithfuelcoolant,lubricanttoolsandsparewheel,ifsuppliedbythevehiclemanufacturerasstandardequipment.(1)ThisDirectivedoesnotpreventanycountryfromhavingadditionalrequirementsforthevehiclepartsforwardofthefrontwheelsandrearwardoftherearwheels.共20頁(yè)第7頁(yè)歐洲共同體公報(bào)附件側(cè)向防護(hù)的技術(shù)要求1.通用說(shuō)明與定義1.1.N2,N3,O3和O4類(lèi)的所有車(chē)輛作為完整實(shí)體，其結(jié)構(gòu)和/或裝備均應(yīng)該為沒(méi)有防護(hù)的道路使用者（行人、騎車(chē)人、騎摩托車(chē)者）提供有效保護(hù)以避免受到車(chē)輛側(cè)面或下面的沖擊（1）。指令不適用于：—用于半掛車(chē)的拖車(chē)，—設(shè)計(jì)和結(jié)構(gòu)專(zhuān)用于長(zhǎng)度不可分割的極長(zhǎng)負(fù)載如木材、鋼條等運(yùn)輸?shù)膾燔?chē)；—設(shè)計(jì)和結(jié)構(gòu)用于特種用途的車(chē)輛，出于實(shí)用性原因，不能安裝這樣的側(cè)向防護(hù)。1.2.如果側(cè)面部件所提供的防護(hù)滿足下段中的規(guī)定，則視為車(chē)輛滿足1.1點(diǎn)中給出的要求。1.3.定義1.3.1.用于側(cè)向防護(hù)的車(chē)輛型式術(shù)語(yǔ)‘用于側(cè)向防護(hù)的車(chē)輛型式’指的時(shí)下列主要特征基本相同的車(chē)輛：對(duì)第2點(diǎn)要求有影響的后橋?qū)挾取④?chē)體和底盤(pán)的結(jié)構(gòu)、尺寸、形狀和材料，車(chē)輛的懸架特征。1.3.2.‘空載重量’指的是處于工作狀態(tài)下的車(chē)輛重量，里面沒(méi)有人員、空載，但是裝備了完整的燃料、冷卻液、潤(rùn)滑油、工具和備胎（如果這些是車(chē)輛廠商所提供的標(biāo)準(zhǔn)設(shè)備）。（）本指令不阻止任何國(guó)家對(duì)前輪前部及后輪后部的車(chē)輛部件提出附加要求。共20頁(yè)第8頁(yè)OffcialJounaloftheEuropeanCommunities1.4.PositioningofthevehicleWhentestedforcompliancewiththetechnicalspecificationssetoutinpoint2,thepositionofthevehicleshallbeasfallows:—onahorizontalandflatsurface,—thesteeredwheelsshallbeinastraight-aheadposition,—thevehicleshallbeunladen,—semi-trailersshallbepositionedontheirsupportswiththeloadingsurfacehorizontal.2.Lateralprotectionprovidedbyaspecificdevice(sideguard)2.1.Thedeviceshallnotincreasetheoverallwidthofthevehicleandthemainpartofitsoutersurfaceshallnotbemorethan120mminboardfromtheoutermostplane(maximumwidth)ofthevehicle.Itsforwardendmaybeturnedinwardsonsomevehiclesinaccordancewithpoints2.4.2and2.4.3.Itsrearwardendshallnotbemorethan30mminboardfromtheoutermostedgeofthereartyres(excludinganybulgingofthetyresclosetotheground)overatleasttherearmost250mm.2.2.Theoutersurfaceofthedeviceshallbesmooth,substantiallyflatorhorizontallycorrugateandsofaraspossiblecontinuousfromfronttorear;adjacentpartsmayhoweveroverlap,providedthattheoverlappingedgefacesrearwardsordownwards,oragapofnotmorethan25mmmeasuredlongitudinallymaybeleft,providedthattherearwardpartdoesnotprotrudeoutboardoftheforwardpart;domedheadsofboltsorrivetsmayprotrudebeyondthesurfacetoadistancenotexceeding10mmandotherpartsmayprotrudetothesameextentprovidedthattheyaresmoothandsimilarlyrounded;allexternaledgesandcornersshallberoundedwitharadiusnotlessthan2,5mm(testedasprescribedinDirective74/483/EEC(2)).2.3.Thedevicemayconsistofacontinuousflatsurface,orofoneormorehorizontalrails,oracombinationofsurfaceandrails;whenrailsareused,theyshallbenotmorethan300mmapartandnotlessthan:—50mmhighinthecaseofcategoryN2andO3vehicles,—100mmhighandessentiallyflatinthecaseofN3andO4vehicles.Combinationsofsurfacesandrailsshallformacontinuoussideguardsubject,however,totheprovisionsofpoint.Theforwardedgeofthesideguardshallbeconstructedasfollows:2.4.1.Itspositionshallbe:(2)OJNoL266,2.10.1974,p.4.共20頁(yè)第9頁(yè)歐洲共同體公報(bào)1.4.按照第2點(diǎn)給出的技術(shù)規(guī)范測(cè)試符合性時(shí)定位車(chē)輛，車(chē)輛的位置應(yīng)該如下：—在水平平整表面上，—轉(zhuǎn)向車(chē)輪應(yīng)該位于正向前方位置，—車(chē)輛應(yīng)該空載。—負(fù)載平面水平時(shí)將半掛車(chē)定位在支架上。2.由特殊裝置（側(cè)擋板）提供的側(cè)向防護(hù)2.1.該裝置不應(yīng)增加車(chē)輛的總寬，并且其外表面的主要部件也不應(yīng)向內(nèi)超過(guò)車(chē)輛最外側(cè)平面（最大寬度）120毫米。按照2.4.2點(diǎn)和2.4.3點(diǎn)，在某些車(chē)輛上，前端可以向內(nèi)轉(zhuǎn)。至少在最后面250毫米以上，其后端不應(yīng)大于后輪胎最外邊緣內(nèi)側(cè)30毫米（輪胎接近地面的凸起除外）。2.2.裝置的外表面應(yīng)該平滑、基本水平或?yàn)樗郊y狀，并盡可能從前延續(xù)到后；但是，如果重疊邊緣朝向后部或向下，則相連部件可以重疊，如果后部部件未伸出到前方部件外側(cè)，則可以留出不超過(guò)25毫米的縱向測(cè)量間隔；螺栓或鉚釘?shù)那蛐畏忸^可以伸到表面外10毫米以?xún)?nèi)，其它平滑及相似圓形的部件也可以伸出同樣長(zhǎng)度；所有外部棱角均應(yīng)修圓到2,5毫米半徑以上（如指令74/483/EEC進(jìn)行測(cè)試（1））。2.3.該裝置可以由一個(gè)連續(xù)的平整表面、或者一個(gè)或多個(
