PartyBshallobservethelaws,decreesandrelevantregulationsenactedbytheChinesegovernmentandshallnotinterferein/r/nChina/r/n'sinternalaffairs./r/n乙方必須遵守中國(guó)的法律、法規(guī)和將關(guān)規(guī)定，不干涉中國(guó)內(nèi)政。/r/n2.

PartyBshallobservePartyA'sworksystemandregulationsconcerningadministrationofforeignexpertsandshallacceptPartyA'sarrangement,direction,supervisionandevaluationinregardtohis/herwork.WithoutPartyA'sconsent,PartyBshallnotrenderserviceelsewhereorholdconcurrentlyanypostunrelatedtotheworkagreedonwithPartyA./r/n乙方必需遵守甲方的工作制度及與外國(guó)專家管理相關(guān)的規(guī)定，并接受甲方在工作方面的安排、指導(dǎo)、監(jiān)督和評(píng)價(jià)。未經(jīng)甲方批準(zhǔn)，乙方不得從事任何兼職工作。/r/n3.

PartyBshallcompletethetasksagreedonscheduleandguaranteethequalityofwork./r/n/r/n乙方必須按照計(jì)劃保質(zhì)保量完成甲方委派的工作。/r/n4.

PartyBshallrespect/r/nChina/r/n'sreligiouspolicy,andshallnotconductreligiousactivitiesincompatiblewiththestatusofanexpert./r/n/r/n乙方必須遵守中國(guó)的宗教政策，不允許從事與外籍專家身份不符的宗教活動(dòng)。/r/n5.

PartyBshallrespecttheChinesepeople'smoralstandardsandcustoms./r/n乙方必須尊重中國(guó)人民的道德規(guī)范和風(fēng)俗習(xí)慣。/r/n6.

IfPartyBhasanycontagiousorseriousdiseases,orifPartyBisfemaleinpregnancy,childbirthorbabynursingperiod,PartyBhasthedutytoinformPartyAbeforethecontractissignedsothatPartyAcanprovidespecialcaretoPartyB.Otherwise,PartyAwillnotbearanyrelatedresponsibilities./r/n/r/n乙方如有嚴(yán)重疾病或傳染性疾病、或者女性有懷孕、待產(chǎn)、哺乳等情況，必須在簽訂合同之前，向甲方如實(shí)聲明，否則造成后果由乙方承擔(dān)全部責(zé)任。/r/nVII.

Revision,CancellationandTerminationoftheContract/r/n合同的修改、取消和終止：/r/n1.

Bothpartiesshouldabidebythecontractandshouldrefrainfromrevising,canceling,orterminatingthecontractwithoutmutualconsent(exceptthatmentionedinVI,6)./r/n/r/n雙方必須嚴(yán)格遵守合同中所規(guī)定的內(nèi)容。不經(jīng)雙方同意，不得擅自單方修改、取消或者終止合同。但本合同第VI條第六款所規(guī)定的情況除外。/r/n2.

Thecontractcanberevised,canceled,orterminatedwithmutualconsent.Beforebothpartieshavereachedanagreement,thecontractshouldbestrictlyobserved./r/n/r/n在雙方同意的情況下，可以對(duì)合同進(jìn)行修改、取消或者終止。但在此之前，必須嚴(yán)格遵守合同。/r/n3.

PartyAhastherighttocancelthecontractwithawrittennoticetoPartyBunderthefollowingconditions;/r/n/r/n在以下情況下，甲方有權(quán)以書面形式通知乙方終止合同：/r/n(1)

PartyBdoesnotfulfillthecontractordoesnotfulfillthecontractobligationsaccordingtothetermsstipulated,andhasfailedtoamendafterPartyAhaspointeditout./r/n/r/n乙方?jīng)]有完成合同中所規(guī)定的內(nèi)容，或者經(jīng)甲方提醒仍沒有履行合同中所規(guī)定的義務(wù)。/r/n(2)

Accordingtothedoctor'sdiagnosis,PartyBcannotresumenormalworkafteracontinued30daysickleave./r/n/r/n經(jīng)醫(yī)生診斷，乙方在連續(xù)30日病假后仍不能恢復(fù)正常工作。/r/n4.

PartyBhastherighttocancelthecontractwithawrittennoticetopartyAunderthefollowingconditions:/r/n/r/n在以下情況下，乙方有權(quán)以書面形式通知甲方終止合同：/r/n(1)

PartyAhasnotprovidedPartyBwithnecessaryworkingandlivingconditionsasstipulatedinthecontract./r/n/r/n甲方?jīng)]有按照規(guī)定為乙方提供工作和生活所需條件和設(shè)備。/r/n(2)

PartyAhasnotpaidPartyBasscheduled./r/n/r/n甲方?jīng)]有按期向乙方發(fā)放勞務(wù)報(bào)酬。/r/nVIII.

BreachPenalty/r/n違約金/r/nWheneitherofthetwopartiesfailstofulfillthecontractorfailstofulfillthecontractobligationsaccordingtothetermsstipulated,thatis,breaksthecontract,itmustpayabreachpenaltyof/r/n￥50000RMB/r/n./r/n/r/n任何一方不能按照合同中所規(guī)定內(nèi)容執(zhí)行，都將視為違約。違約方應(yīng)承擔(dān)/r/n￥50000元/r/n人民幣/r/n的違約金。/r/nIfPartyBaskstocancelthecontractduetoeventsbeyondcontrol,itshouldproducecertificationsbythedepartmentconcerned,obtainPartyA'sconsent,andpayitsownreturnexpenses;IfPartyBcancelsthecontractwithoutvalidreason,itshouldpayitsownreturnexpensesandpaybreachpenaltytoPartyA.IfPartyAaskstocancelthecontractduetoeventsbeyondcontrol,withtheconsentofPartyB,itshouldpayPartyB'sreturnexpenses;ifPartyAcancelsthecontractwithoutvalidreason,itshouldpayPartyB'sreturnexpensesandpayabreachpenaltytoPartyB./r/n/r/n如果因不可抗原因乙方請(qǐng)求終止合同，須出示有關(guān)部門開具的證明材料，經(jīng)甲方批準(zhǔn)，自費(fèi)返程路費(fèi)。如果沒有正當(dāng)理由乙方擅自終止合同，乙方應(yīng)自費(fèi)返程路費(fèi)，并承擔(dān)違約責(zé)任。如果甲方因不可抗原因結(jié)束合同，經(jīng)乙方同意后，應(yīng)由甲方負(fù)責(zé)提供乙方返程路費(fèi)。如甲方?jīng)]有正當(dāng)理由擅自終止合同，應(yīng)負(fù)責(zé)向乙方提供返程路費(fèi)，并承擔(dān)違約責(zé)任。/r/nIX.

NewYear'sDay,SpringFestival,MayDay,NationalDayandotherholidaysstip/r/nulatedbylawsandregulations./r/n/r/n受雇方在中國(guó)享有以下假期和假日：/r/n元旦，春節(jié)，“五·一”勞動(dòng)節(jié)，國(guó)慶節(jié)以及法律、法規(guī)中所規(guī)定的其他節(jié)日。/r/nⅣ/r/nSickleaveandprivateaffairsleave/r/n病假和個(gè)人事假/r/n

1.Certificatefromdoctorsforforeignersappointedbythehostinstitutionshouldbepresentedwhentheemployedpartyasksforsickleave./r/n受雇方請(qǐng)病假應(yīng)持有雇用方指定的醫(yī)療機(jī)構(gòu)開具的醫(yī)療證明。/r/n2.Privateaffairsleaveoftheemployedpartyshallbeapprovedbytheemployingparty.Theemployingpartywilldeductthesalarybyday.Inthecontractterm,theprivateaffairsleavesshouldnotexceed10days.Thecontinuousprivateaffairsleaveshallbenomorethan3days,andtwodays'salarywillbedeductedforeachdaythereafter./r/n/r/n雇用方應(yīng)準(zhǔn)許受雇方請(qǐng)個(gè)人事假。期間工資按照天數(shù)扣除。在合同期內(nèi)不超過10天。單次事假原則上不能超過3天，超過3天后每天扣除2天的工資。/r/n
