3、periodcommencingonthedateofandendingonthedateof20XX-9-30.第四條根據(jù)甲方工作需要及任職要求，乙方同意以兼職形式為甲方提供如下服務：Baseontheneedsandrequirementoffirstparty,secondpartyprovidepart-timeserviceasfollows:1，與甲方指定客戶進行約見和面談，依甲方要求、協(xié)助甲方處理相關事宜;meetappointedcostumers,accordingtotherequirementfromfirstparty,providecorrelativeassista

4、nce.2，根據(jù)甲方要求協(xié)助甲方處理緊急事件;Baseontheneedsoffirstparty,provideassistanceonemergency.3，作為培訓講師，為甲方培訓提供培訓支持工作。Astrainer,provideassistanceontraining.第五條甲方每月8日（公歷，遇節(jié)假日順延）支付乙方上月服務報酬,乙方服務報酬（稅前）為：人民幣1000_元/次*天；大寫：人民幣1XXX元/次*天。如服務時間不足半天服務費用以XXX元/小時計算。Bythe8thdayofeachmonth(theGregoriancalendar,postponeinthecaseof

7、甲方商業(yè)秘密不對外泄露的義務，也不能用于為自己謀取利益的經(jīng)營活動中。乙方不得將涉及甲方商業(yè)秘密的實物、文字材料、電子文檔等以竊取、摘抄、復制、傳真、拍照、電子郵件等方式占有、傳播、出售、使用或允許他人使用甲方的商業(yè)秘密。本條款所規(guī)定行為，乙方如有違反，應向甲方支付違約金人民幣壹拾萬元employer-employeerelationship,usethetradesecretfromfirsttomarketingtacticsmarketingchannelBecauseofthesecondpartywouldknowandparty(includebutnotlimitedsalarys

9、rletotherpeopleusethearticle、writtenmaterials、electronicdocumentbystealing、extracting、copying、faxing、photographing、emailingandothermethods.Alltheactionsunderthisclause,ifsecondpartycommittedthebreach,shouldpaypenalsumof100,000RMB.第九條乙方有下列情形之一的，甲方可以解除本協(xié)議，但是應當提前十日以書面形式通知乙方：Firstpartycouldcarryoutresci

10、ssionofcompactinanyofthefollowingcircumstances,however,shouldnoticesecondpartybywrittenform10daysearly.患病或者非因工負傷，醫(yī)療期滿后，不能從事原工作也不能從事由甲方另行安排的工作的;Inthecaseoffallillorwoundinlineofduty,whenthemedicaltreatmentexpires,ifnotbeabletoparticipateformerworkorotherappointedworkfromfirstparty;不能勝任工作，經(jīng)過培訓或調(diào)崗，仍不能勝

11、任工作的;Incompetent,aftertrainingortransfer-position,stillincompetent;本協(xié)議訂立時所依據(jù)的客觀情況發(fā)生重大變化，致使協(xié)議無法履行，經(jīng)甲乙雙方協(xié)商不能就變更協(xié)議內(nèi)容達成一致的;Duetoobjectivereasons,unabletofulfillcompact,moreover,cannotreachtoanagreementwithvariationoncontract.法律、行政法規(guī)規(guī)定可以解除協(xié)議的。Rescissionofcompactisinaccordwithlawandadministrativeregulatio

12、n.第十條乙方有下列情形之一的，甲方可以單方面隨時解除協(xié)議，并對乙方不作任何經(jīng)濟補償乙方因下列行為給公司造成損害的，甲方有權(quán)要求乙方賠償損失：Firstpartycouldcarryoutrescissionofcompactinthefollowingcircumstancesatanytime,withoutmakinganycompensation;firstpartyhastherighttoletthesecondpartycompensateforlossinanyofthefollowingcircumstances.在應聘過程中提供的個人證件、體檢、簡歷等個人資料有欺詐行為的;

13、Iftherewerefraudactsonpersonalpapers、medicalcertificates、resume;按公司獎懲的有關規(guī)定，嚴重失職，工作不負責任，玩忽職守、消極懈怠給公司利益造成損害的;Inaccordancewithcorrelativeprovisionofreward/punish,grossneglectofduty,irresponsible,listlessduringwork,resultlosstoprofitofcompany.乙方盜竊公司、員工或客戶財物的;報銷費用時有虛報或假報金額等行為的;Secondpartystealpropertyfro

14、mcompanyoremployees;deceptionduringtheprocessofapplyingforreimbursement.泄露公司商業(yè)秘密;利用職務以權(quán)謀私、損公肥私的;Breachofconfidence;takeadvantageofdutytoseekpersonprofit.欺詐客戶、公司，謀取私利的，私下從事同業(yè)工作的;Stingclient、companytoseekpersonalprofit,participatesametypeofworkinsecret結(jié)黨營私、破壞員工關系，生活作風不端正的;Formcliques,wreckrelationship

15、sBetweenemployees,badlifestyle(immorallove).違法行為或不良社會行為而給甲方形象造成巨大傷害的;unlawfulactorbadbehaviorwhichdiminishthereputationofTalent.有賭博、吸毒等不良行為的;gamble、drugtakingorotherbadbehavior被依法追究刑事責任或違法被處罰的;Beingundertakenforcriminalresponsibilityorpunishedforbreakingthelaw.嚴重違反公司的勞動紀律、規(guī)章制度的;法律規(guī)定或雙方約定的其它情形。Commit

16、tingaseriousbreachofdiscipline、regulationorotheragreementbetweentwoparties.第十一條乙方解除協(xié)議，應當提前三十日以書面形式通知甲方。Secondpartymakeearlyrescissionofcompact,shouldprovide30dayspriornoticetofirstparty.第十二條甲乙雙方約定無論何種情形解除協(xié)議，乙方都對工作交接負有責任，須按甲方規(guī)定的程序進行工作交接。乙方不按甲方的規(guī)定交接工作的，甲方有權(quán)扣發(fā)乙方服務費;乙方不按規(guī)定交接工作致使甲方遭受損失時，甲方將依法向乙方索賠。Nomatt
