2、表現(xiàn)在相關(guān)法律體系還不成熟、規(guī)章制度缺乏科學性等。本文主要以網(wǎng)絡(luò)謠言的行政責任為研究對象，嘗試建構(gòu)一個有關(guān)網(wǎng)絡(luò)謠言的行政責任法律框架。文章共分四個部分：第一部分講的是網(wǎng)絡(luò)謠言的概述。首先，對謠言的歷史、謠言的含義進行了分析，并指出為與我國法律意義上的" 謠言" 概念相對應，本文采用的是狹義" 謠言 " 概念。在此基礎(chǔ)上， 明確了網(wǎng)絡(luò)謠言的定義，即是指經(jīng)由網(wǎng)絡(luò)廣泛傳播的沒有事實依據(jù)的虛假言論。其次，針對網(wǎng)絡(luò)謠言的特征、類型、傳播、現(xiàn)實危害性等進行了闡述。第二部分講的是反網(wǎng)絡(luò)謠言的行政法治原則。首先，指出言論自由作為一項憲法性

3、權(quán)利具有促進自由、提升民主、發(fā)現(xiàn)真理等功能，應當受到法律嚴格保護，同時，通過對言論自由相對主義和絕對主義兩種學說的比較分析，表明言論自由也是有限度的。其次，通過對各國在限制言論自由方面的制度比較，進一步提出我國在反網(wǎng)絡(luò)謠言過程中應當遵循的行政法原則。第三部分講的是網(wǎng)絡(luò)謠言行政責任的構(gòu)成要件。該部分也是本文的核心，分別從網(wǎng)絡(luò)謠言違法的主體、客體、主觀方面、客觀方面等四個角度出發(fā)，試圖建構(gòu)一個行政方面網(wǎng)絡(luò)謠言違法的模型。期間， 指出網(wǎng)絡(luò)謠言的違法主體可以分為網(wǎng)絡(luò)謠言參與者和網(wǎng)絡(luò)管理者兩類， 并提出對不同類型的違法主體，在構(gòu)成要件方面也會有所不同。第四部分講的是我國反網(wǎng)絡(luò)謠言行政法治體系的現(xiàn)狀與完善

4、。該部分對我國目前在反網(wǎng)絡(luò)謠言領(lǐng)域的主要行政法規(guī)范進行梳理，指出當前在規(guī)制網(wǎng)絡(luò)謠言方面存在立法凸顯滯后、立法等級較低、監(jiān)管不到位等問題。在此基礎(chǔ)上，提出了明確立法權(quán)限、完善相關(guān)制度規(guī)范、健全監(jiān)管處置機制、營造網(wǎng)絡(luò)法治環(huán)境等對策建議。關(guān)鍵詞網(wǎng)絡(luò)謠言；言論自由；行政責任AbstractWith the rapid development of network technology, Internethas brought greatconvenience to people’s life. However, it also becomes the platform where

5、rumors arecaused and spread, which violates the rights of citizens, disturbs social order and evenharms national safety. It is an urgent reality problems as to how to set the legal borderof network opinion so as to effectively restrict network rumors.At present, laws and regulations in terms of netw

6、ork opinion freedom are still notcomplete, mainly embodied in related immature law system and lack of scientificity inregulations. This paper takes the administrative responsibility of network rumor as theresearch object and attempts to construct a legal structure of administrativeresponsibilities r

7、elated to network rumor. The paper includes four parts:The first part is the overview of network rumor. First of all, it analyzes thehistory and definition of rumor and indicates that in order to discriminate from theconcept of ‘rumor’ in law, this paper adopts the narrow concept

8、 of ‘rumor’ 。 Based onthis, it confirms the definition of network rumor, which refers to the false speechwithout factual evidence that is widely spread through network. Second, it illustratesthe features, types, spread and real harmfulness.The second part is administrative law pr

First of all,it indicates that freedom of speech, as a constitutional right, has the function ofpromoting freedom, promoting democracy andfinding the truth and thus should bestrictly protected by law; meanwhile, through comparative analysis of twotheories -relativism a

10、nd absolutism, it shows that freedom of speech is also limited.Second, through comparison of institutions in restricting freedom of speech of thecountries, it further proposes the rules of administrative law that our country shouldadhere to in the process of anti network rumor.The third part is the

11、components of administrative responsibilities of networkrumor. This part is the core of this paper; it tries to construct a model of law violationof network rumor in administrative aspects from the perspective of the subject, object,subjective aspect and objective aspect in terms of law violation in

12、 administration. Itindicates that the subject of law violation of network rumor is divided intoparticipators of network rumor and network managers. It also proposes that aiming atthe subject of law violation of different types, it is also different in component.The fourth part is the current situati

13、on and perfection of administrative lawsystem of anti-network rumor. It sorts out the main standards of administrative law inthe field of anti network rumor. It indicates that there exists problems in legislationlagging, low legislative grade and poor supervision etc. On this basis, it proposes thes
