TheleasedpropertyshallbeusedbypartyBforresidentialpurpose.PartyAhastherighttoterminatetheleaseandreporttoauthority,ifPartyBviolatethelawofChinawhenliveintheapt.(Drugabuse,Prostitution,Gambling,etc)四、租賃期Termoftenancy:4.1租賃期為__12_月,自2月____日起至_年_8_月____日止。起租日為2月日。乙方不得提前終止合約,不然確保金將被沒收。

5.1雙方談定租金為每個月___3000___人民幣,租金包含除水、電、液化氣、電話費以外一切管理費。

PartyBwillpay3monthsrentfeeevery3months,Iftherentunpaidfor5daysaftertheday,whichitshouldbepaid,partyBshouldbeliabletopayalatepenaltyfeeequalto3%oftherentperday.Iftherenthasnotbeenpaidformorethan10daysaftertheduedate,partyBwillbedeemedtohaveautomaticallyterminatedthetenancyresultinginabreachofthisagreement.PartyAwillthenbeentitledtotaketheleasedpropertyandforfeitthedepositandterminatethetenancyagreementimmediately.六、確保金Securitydeposit:6.1為確保出租房屋及其設(shè)施之安全并完好及租賃期內(nèi)相關(guān)費用之準(zhǔn)期結(jié)算,乙方同意于簽署協(xié)議2天內(nèi)支付給甲方壹個月租金租賃押金計_3000_人民幣作為乙方確保協(xié)議推行之確保金。乙方搬入后五天內(nèi)付叁個月租金計_9000人民幣。

Toensuretheprotectionandgoodconditionoftheleasedpropertyandtherelatedfacilitiesaswellasthepromptpaymentandsettlementofallrelatedchargesduringthetermoftenancy,partyBagreestopay3000RMBtopartyAwith2dayswhentheexecutionofthisagreementasecurityforpartyb’sobligationshereunder.whenpartyBmovein,partyBpaythreemonth’srentalintheamountof_9000RMB__with5days.6.2甲方同意乙方續(xù)租外,乙方已在本協(xié)議租期滿后當(dāng)日返還該房屋,甲方在檢驗房屋無誤后,退還乙方押金。

Exceptotherwiseprovidedinthisagreement,whenthiscontractended,afterpartyAcheckedtheapartment,ifthereisnothingbroken,partyAshallreturntopartyBtheentiredeposit.七、甲方責(zé)任PartyA’sobligations:7.1甲方須按時將出租房屋及其家私家俱用具與其設(shè)施以良好狀態(tài)交付乙方使用。

Partyashalldeliveronscheduletopartybvacantpossessionoftheleasedpropertyincludingthefurniture,furnishingandappliancesandtherelatedfacilitiesforpartyb’suse(furniture,furnishingandappliancestobedetailedinappend.)7.2租賃期內(nèi)甲方不得收回出租房屋（除非本協(xié)議另有要求）,甲方確保乙方可不受干擾享用該物業(yè)。

PartyAshouldnotrepossesstheleasedpropertyduringthetermofpartyadisturbofinterferewithpartyb’squietenjoymentoftheleasedproperty.

7.3在乙方遵守本協(xié)議條款及支付租金前提下,乙方有權(quán)于租賃期內(nèi)拒絕甲方或其她人騷擾而平靜享用出租房屋。

IfpartyBpaystherentandperformsandobservespartyB‘stermsandconditionsinaccordingwiththisagreement,partyBshallbeentitledtoholdandenjoytheleasedpropertythroughoutthetermofthistenancywithoutanyinterruptionbypartyAoranyotherperson.7.4租賃期內(nèi)出租房屋結(jié)構(gòu),進(jìn)出物業(yè)排水、上下管道、電路等處于良好使用狀態(tài)。

Partyaagreestorepairandmaintainthestructure,drains,pipesandcables,etc.leadingintoorfromtheleasedpropertyatalltimesingoodandtenablerepairduringthetermofthistenancy.八、乙方責(zé)任PartyB’sobligations:8.1乙方應(yīng)按協(xié)議要求,按時支付租金,確保金及其她各項應(yīng)付費用。

Partybshouldpromptlypayallrent,securitydepositandotherchargespayablebyitinaccordancewiththetermsofthisagreement.8.2乙方應(yīng)珍惜使用出租房屋,如因乙方過失或過失致使房屋設(shè)施及屋內(nèi)用具和飾品受到損壞（正常損耗除外）,乙方應(yīng)負(fù)賠償責(zé)任。

Partybshalltreattheleasedpropertywithcare.ifasaresultofpartyb’snegligenceormisconduct,theleasedpropertyandtherelatedfacilitiesandaccessoriessufferanydamage(fairwearandtearexcepted),partyBshallberesponsibleforcompensatingpartyaforsuchdamages.8.3乙方應(yīng)按本協(xié)議約定正當(dāng)使用出租房屋,不得私自改變使用性質(zhì),不應(yīng)存放中國法律下所嚴(yán)禁危險物品,如所以發(fā)生損害,乙方應(yīng)負(fù)擔(dān)全部責(zé)任。

PartyBshouldusetheleasedpropertylegallyasagreedinthisagreement.PartyBshouldnotstoreanydangerousitemswhichareprohibitedbythelawsinthepeople’srepublicofchinaintheleasedpropertyandshallbefullyresponsibleforanydamagesoflossesasresultthereof.8.4未經(jīng)甲方事先書面同意,乙方不得將出租房屋轉(zhuǎn)租或租給其她第三者。

Withoutpartya’spriorwrittenconsent,partyBmaynotassignthetenancyorsublettheleasedpropertytoathirdparty.九、違約處理BreachofAgreement:乙方有下列行為之一,甲方有權(quán)終止本協(xié)議,收回出租房屋,而且確保金不予返還;

PartyAshallhavetherighttoterminatethisagreement,repossesstheleasedpropertyandforfeitthesecuritydepositifpartyBcommitsoneofthefollowing:

a.未得甲方書面書面同意,將出租房屋私自轉(zhuǎn)租;

Subletstheleasedpropertywithoutpartya’sagreement;

b.未得甲方同意將出租房私自拆改結(jié)構(gòu)或改變用途:

Altersthestructureoftheleasedpropertyorusestheleasedpropertyotherthanforthepurposestartedhereinwithoutpartya’sconsent;

c.無故拖欠租金超出三天（除雙方就本協(xié)議存在爭議除外）。

Failstopayrentwithoutanyreasonformorethanthirty(3)daysaftertheduedateexceptwherethereisadisputeinrespectofthisagreement.十、適使用方法律Applicablelaw:本協(xié)議成立,其有效性、堅固、簽署和處理與其她相關(guān)一切糾紛均應(yīng)受中國法律管轄并依據(jù)中國法律解釋。Theformationofthisagreement,itsvalidity,interpretationandsettlementofanydisputesarisinghereundershallbegovernedbyandconstruedinaccordancewiththelawsofthepeople’srepublicofchina.十一、爭議處理Disputeresolution凡因?qū)嵤┍緟f(xié)議所產(chǎn)生或與本協(xié)議相關(guān)一切爭議,雙方應(yīng)經(jīng)過友好協(xié)商處理;協(xié)商不成,應(yīng)提交中國國際經(jīng)濟(jì)貿(mào)易仲裁委員會,按其仲裁規(guī)則和中國仲裁法進(jìn)行仲裁。仲裁處理是終局,對雙方都有約束力。

Inthecaseofdisputesarisingoverthisagreementofanymattersrelatedhereto,thepartiesshallnegotiateingoodfaithtoresolvesuchdisputes.ifsuchnegotiationfails,thepartiesshallsubmitthedisputetoarbitrationbythechinainternationaleconomicandtradearbitrationcommissioninaccordancewithitsarbitrationrulesandthearbitrationlawofthepeople’srepublicofchina.thedecisionofthearbitrationbodyisfinalandshallbebindingonthepartieshereto.
