formedandshall,wherenecessary,holdappropriateconsultationsforthepurposeofreachingasettlement.共16頁第5頁1970L0388——2004年5月1日—006.001B第二條各成員國依據第一條對聲響報警裝置批準型式進行了認證之后，各成員國應給相應的制造商或其授權代理商發予放歐共體零部件EEC型式認證標記，該標記應按照與附件I第1.4項所示式樣相符。各成員國應采取適當措施，防止按照第一條之要求取得型式認證后的聲響報警裝置使用容易和其他裝置發生混淆的標記，在使用時與其它裝置產生混淆。第三條1．如果聲響報警裝置標附有EEC歐共體型式認證標記，則各成員國不得以與因為這些裝置結構或者操作方法工作方式為理由的原因，禁止其上市銷售。2．然而，如果對標附有歐共體EEC認證標記的聲響報警裝置，如果其在設計上與認證過的原型不符相一致，本規定不應阻止成員國可以采取上述措施。該成員國應即刻將其采取的措施通知其它成員國和委員會，詳細并說明相關依據有關理由。同時應執行第五條的規定也應適用。倘若不遵守滿足附件I第項中規定的上下限，則應認為屬于在第一款含義范圍內無法與第一小段中提到的與認證過的原型相不一致符的情況。第四條各成員國的主管當局發證機關應在一個月內將其批準或者拒絕批準認證的各類型聲響報警裝置的型式認證證書副本發送至其它成員國的主管當局發證機關。第五條1．如果批準準予歐共體EEC零部件型式認證的成員國發現很多大量帶有歐共體零部件型式認證標記的聲響報警裝置與認證過的相同認證標記的型式不符，則該成員國可以采取必要措施保證產品生產模型與得到認證的型式相符。該成員國的主管當局發證機關應該告知建議其它成員國的主管當局發證機關所采取的相應措施，如果有必要直至如果這些聲響報警裝置始終不能與經過認證的型式相符，可以撤銷其歐共體該EEC型式認證。上述成員國的主管當局發證機關，在如果接到發生此類情況的其他成員國主管當局發證機關的類似不一致的通知后，也應采取同樣的措施。2．各成員國的主管當局發證機關應在撤銷歐共體零部件EEC型式認證之后一個月之內通知其它成員國主管當局發證機關，同時告知采取此類措施的理由。3．批準EEC準予歐共體型式認證的成員國，如果對被通告通知它的與認證不符的情況存有爭議，有關各成員國應盡力解決爭端。有相關情況應通知委員會，在必要時，委員會應主持進行磋商，以達到解決爭端的目的。共16頁第6頁1970L0388—N—01.05.2004—006.001BArticle6AlldecisionstakenpursuanttotherulesadoptedinimplementationofthisDirectiveandrefusingorwithdrawingapprovalforanaudiblewarningdeviceorprohibitingitsmarketingoruseshallstateindetailthereasonsonwhichtheyarebased.Adecisionshallbenotifiedtothepartyconcerned,whoshallatthesametimebeinformedoftheremediesavailabletohimunderthelawsinforceintheMemberStatesandofthetimelimitsallowedfortheexerciseofsuchremedies.Article7NoMemberStatemayrefusetograntEECtypeapprovalornationaltypeapprovalofavehicleongroundsrelatingtoitsaudiblewarningdeviceifthatdevicebearstheEECapprovalmarkandifitisfittedinaccordancewiththerequirementslaiddowninitem2ofAnnexI.▼A1Article7aNoMemberStatemayrefuseorprohibitthesaleorregistration,entryintoserviceoruseofavehicleongroundsrelatingtoitsaudiblewarningdeviceifthatdevicebearstheEECapprovalmarkandifitisfittedinaccordancewiththerequirementslaiddowninitem2ofAnnexI.▼B

Article8ForthepurposesofthisDirective,‘vehicle’meansanymotorvehicleintendedforuseontheroad,withorwithoutbodywork,havingatleastfourwheelsandamaximumdesignspeedexceeding25km/h,withtheexceptionofvehicleswhichrunonrails,agriculturaltractorsandmachinery,andpublicworksvehicles.Article9TheamendmentsnecessaryforadjustingtherequirementsofAnnexesIandIIsoastotakeaccountoftechnicalprogressshallbeadoptedinaccordancewiththeprocedurelaiddowninArticle13oftheCouncilDirectiveof6February1970ontheapproximationofthelawsoftheMemberStatesrelatingtothetypeapprovalofmotorvehiclesandtheirtrailers.Article101．MemberStatesshallputintoforcetheprovisionscontainingtherequirementsneededinordertocomplywiththisDirectivewithineighteenmonthsofitsnotificationandshallforthwithinformtheCommissionthereof.2．MemberStatesshallensurethatthetextsofthemainprovisionsofnationallawwhichtheyadoptinthefieldcoveredbythisDirectivearecommunicatedtotheCommission.Article11ThisDirectiveisaddressedtotheMemberStates.共16頁第7頁1970L0388——2004年5月1日—006.001B第六條應詳細說明以下作法依據的理由：依據本指令實施過程中采用的法規規則而做出的所有決定；聲響報警裝置認證的拒絕或者撤消；聲響報警裝置的禁止銷售或者使用。應將上述決定通知有關方面相關方，同時應通知后者按照成員國現行正在實施中的法律其可以采取的補救措施采取的補救措施，以及實施補救措施實施上述補救措施的時間期限。第七條如果聲響報警裝置附著有EEC歐共體零部件型式認證標記，并且其安裝符合附件I第2項中的規定要求，則各成員國不得因為以與聲響報警裝置的原因有關的理由，拒絕批準給相關車輛的發予歐共體EEC型式認證或國家型式認證。▼A1第七a條如果聲響報警裝置附著有EEC歐共體零部件型式認證標記，并且其安裝符合附件I第2項中的規定要求，則各成員國不得以與因為聲響報警裝置有關的理由的原因，拒絕或者禁止相關車輛的銷售、注冊、投入運行或使用。▼B

第八條本指令中，“車輛”指的是設計用于道路行駛、裝有或未裝車體、至少有四個車輪、最大設計車速超過25公里/小時的所有機動車及其掛車。在鐵路軌道上行駛的車輛、農用拖拉機和機械設備以及公用工程車輛除外。第九條為了考慮到技術的發展，有必要調整附件I和附件II中的要求，應按照1970年2月6日委員會指令關于機動車及其掛車型式認證的第十三條中的規定的程序，采用采納相應的校正附件I和附件II的要求所需的修正案。該指令是關于各成員國機動車及其掛車車型認證的近似法律。第十條1．各成員國應為了在本指令通告后十八個月內遵照，開始執行包含滿足本指令所需要的要求的規定，各成員國應實施必需的規定，并即時將實施相關情況通知委員會。2．各成員國應保證將本指令所涉及領域內其所采用的本國法之主要條款原文傳達給委員會。第十一條本指令通過寄送方式下發至各成員國。共16頁第8頁1970L0388—N—01.05.2004—006.001BANNEXI1．EECTYPEAPPROVALOFANAUDIBLEWARNINGDEVICE1.1Thewarningdeviceshallemitacontinuoussound.1.2Thewarningdeviceshallhaveacousticcharacteristics(frequencyspectrumofthesound,levelofsoundpressure)andmechanicalcharacteristicssuchthatitcansatisfythefollowingtests,intheorderindicated.1.2.1MeasurementofsoundlevelThewarningdeviceshallbetestedinasufficientlysilentandopenarea(1)(ambientnoiseandwindnoiseatleast10db(A)belowthenoisebeingmeasured)orinananechoicchamber;themicrophoneofthemeasuringinstrumentshallbelocatedinthedirectioninwhichthesubjectivesoundlevelisatamaximumand2mfromthefrontsurfaceofthedevice,themicrophoneandthedevicebeingpositionedataheightof1·20mabovegroundlevel.Themeasurementsshallbemadeonthe‘A’weightingscaleoftheIEC(InternationalElectrotechnicalCommission)standard,bymeansofsound-levelmetersconformingtothetypedescribedinPublications179,1sted.(1965),oftheInternationalElectrotechnicalCommission.Thedeviceshallbesuppliedwithavoltageof6·5,13or26voltsmeasuredattheterminalofthesourceofelectricpower,correspondingrespectivelytoaratedvoltageof6,12or24volts.Theresistanceoftheconnectingleads,includingtheresistanceoftheterminalsandcontacts,mustbe:0.05ohmsfora6voltcircuit0.10ohmsfora12voltcircuit0.20ohmsfora24voltcircuitThedeviceshallberigidlymounted,usingthepartorpartsprovidedbythemanufacturer,onasupportwhosemassisatleasttentimesthatofthedeviceandnotlessthan15kg.Undertheaboveconditions,thesubjectivesoundpressurelevelmustbenotmorethan118dB(A)andnotlessthan105dB(A).Thetimelapsebetweenthemomentofactivationandthemomentatwhichthesoundreachestheminimumlevellaiddowninitemabovemaynotexceed0·2seconds,measuredinanambienttemperatureof20±5oC.Thisprovisionshallapplyinparticulartopneumaticallyorelectro-pneumaticallyoperateddevices.Deviceswhicharepneumaticallyorelectro-pneumaticallyoperatedmust,withthepneumaticcircuitarrangedinaccordancewiththemanufacturer'sspecification,havethesameacousticperformanceasthatrequiredforelectricallyoperatedaudiblewarningdevices.1.2.2EndurancetestsThewarningdevicemustbesuppliedwithoneoftheratedvoltagesspecifiedinitemabove,throughconnectingleadshavingoneoftheresistancesasspecifiedinitemabove,andbeoperated50000times,eachtimeforaperiodofonesecond,followedbyafour-secondbreak.Duringthetest,thedevicemustbeventilatedbyanaircurrenthavingaspeedofapproximately10m/s.Ifthetestiscarriedoutinananechoicchamber,thelattermustbeofsufficientvolmuetoallownormaldispersaloftheheatemittedbythedeviceduringtheendurancetest.(1)Theaforementionedareamaytaketheform,forinstance,ofanopenspaceof50mradiushavingacentralpartofatleast20mradiuswhichispracticallylevel,surfacedwithconcrete,asphaltorsimilarmaterial,andnotcoveredwithpowderysnow,tallgrass,lightsoilorashes.Measurementsshallbecarriedoutinfineweather.Nopersonotherthantheobservertakingthereadingsfromtheapparatusmayremainneartheaudiblewarningdeviceorthemicrophone,asthepresenceofspectatorsnearcitherthedeviceorthemicrophonemayconsiderablyaffectthereadingsfromtheapparatus.Fluctuationsofthepointerwhichappeartobeunrelatedtothecharacteristicsofthegeneralsoundlevelshallbeignoredintakingreadings共16頁第9頁1970L0388——2004年5月1日—006.001B附件I1．聲響報警裝置的歐共體EEC型式認證1.1報警裝置應能發出連續的聲響。1.2報警裝置應具有相應的聲學特性（聲音的頻譜，聲壓級）和機械特性，應能按照指定的順序滿足下面所規定的順序的試驗要求。1.2.1聲級的測量報警裝置的試驗應在足夠安靜和開闊的場所（1）（環境噪聲和風噪聲至少低于被測聲音10分貝（A））或者在一個消聲室中進行；測量儀的麥克風的放置應朝著主管主觀聲級最大的方向并且距裝置的前表面2米，麥克風和裝置的高度應距地面1.20米。測量應按照IEC（國際電工委員會）標準的加權等級‘A’進行，所使用的聲級測量儀應符合國際電工委員會第179號出版物第一版（1965）規定的型號。向額定電壓為6伏、12伏或24伏的裝置提供的電壓在電源接線端的測量值應分別為6.5伏，、13伏或26伏，分別對應6伏，12伏或24伏的額定電壓。連接線的電阻，包括接線端和觸點的電阻，必須是：對于6伏的電路：0.05歐姆對于12伏的電路：0.10歐姆對于24伏的電路：0.20歐姆應當利用制造商提供的部件將裝置緊緊固定在支座上，支座的重量至少應為裝置的10倍且不少于15公斤。在上述條件下，主觀聲壓級不得高于118分貝（A）且不得低于105分貝（A）。在20±5oC的環境溫度下測量時，從激活到聲音達到上面中規定的最低主觀聲壓級之間的時延不應超過0.2秒，本條款專門適用于氣動或電動-氣動裝置。在氣動或電動-氣動裝置的氣動回路按照制造商的說明規范布置時，該裝置的聲學特性性能必須與對電動聲響報警裝置的要求相一致。1.2.2耐久試驗必須向報警裝置的供應電壓應滿足提供中的規定的的額定電壓之一，連接線的電阻應滿足為上面的中規定的電阻之一，運行50000次，每次持續一秒鐘，間隔時間為4秒鐘。試驗過程中，應使用速度約為10米/秒的氣流向對裝置通風。若試驗在一個消聲室里進行，該消音聲室的容積空間應足以消散保證該裝置在耐久試驗過程中散發出的熱量正常散熱。（1）例如，該場所可以是，一塊半徑為50米的場地，中央至少有半徑為20米的較為平坦的區域，場地表面為混凝土、瀝青或類似的材料，并且沒有粉末狀雪、高草、輕質土壤或灰塵。測量應在良好的天氣進行。除了一名從儀器上讀取數值的觀測人員外，其他人不得在聲響報警裝置或麥克風附近停留，因為裝置或麥克風附近的旁觀人員可能對儀器的讀數產生實質性影響。讀取數值時應忽略與一般聲級特性無關的指針震動波動。共16頁第10頁1970L0388—N—01.05.2004—006.001BTheambienttemperatures
