22、在在規(guī)定的時(shí)間間內(nèi)向設(shè)計(jì)人人提交基礎(chǔ)資資料及文件，并并對(duì)其完整性性、正確性及及時(shí)限負(fù)責(zé)。發(fā)發(fā)包人不得要要求設(shè)計(jì)人違違反國(guó)家有關(guān)關(guān)標(biāo)準(zhǔn)進(jìn)行設(shè)設(shè)計(jì)。發(fā)包人提交上述述資料及文件件超過規(guī)定期期限15天以內(nèi)，設(shè)設(shè)計(jì)人按本合合同第六條規(guī)規(guī)定的交付設(shè)設(shè)計(jì)文件時(shí)間間順延；發(fā)包包人交付上述述資料及文件件超過規(guī)定期期限15天以上時(shí)時(shí)，設(shè)計(jì)人有有權(quán)重新確定定提交設(shè)計(jì)文文件的時(shí)間。9.1.2發(fā)包包人變更委托托設(shè)計(jì)項(xiàng)目、規(guī)規(guī)模、條件或或因提交的資資料錯(cuò)誤，或或所提交資料料作較大修改改，以致造成成設(shè)計(jì)人設(shè)計(jì)計(jì)返工時(shí)，雙雙方除另行協(xié)協(xié)商簽訂補(bǔ)充充協(xié)議（或另另訂合同）、重重新明確有關(guān)關(guān)條款外，發(fā)發(fā)包人應(yīng)按設(shè)設(shè)計(jì)人所耗工工作量

23、向設(shè)計(jì)計(jì)人支付返工工費(fèi)。在未簽訂合同前前發(fā)包人已同同意，設(shè)計(jì)人人為發(fā)包人所所做的各項(xiàng)設(shè)設(shè)計(jì)工作，發(fā)發(fā)包人應(yīng)支付付相應(yīng)設(shè)計(jì)費(fèi)費(fèi)。9.1.3在合合同履行期間間，發(fā)包人要要求終止或解解除合同，設(shè)設(shè)計(jì)人未開始始設(shè)計(jì)工作的的，不退還發(fā)發(fā)包人已付的的定金；已開開始設(shè)計(jì)工作作的，發(fā)包人人應(yīng)根據(jù)設(shè)計(jì)計(jì)人已進(jìn)行的的實(shí)際工作量量，不足一半半時(shí)，按該階階段設(shè)計(jì)費(fèi)的的一半支付；超過一半時(shí)時(shí)，按該階段段設(shè)計(jì)費(fèi)的全全部支付。9.1.4發(fā)包包人必須按合合同規(guī)定支付付定金，收到到定金作為設(shè)設(shè)計(jì)人設(shè)計(jì)開開工的標(biāo)志。未未收到定金，設(shè)設(shè)計(jì)人有權(quán)推推遲設(shè)計(jì)工作作的開工時(shí)間間，且交付文文件的時(shí)間順順延。9.1.5發(fā)包包人應(yīng)按本合合同規(guī)

24、定的金金額和日期向向設(shè)計(jì)人支付付設(shè)計(jì)費(fèi)，每每逾期支付一一天，應(yīng)承擔(dān)擔(dān)應(yīng)支付金額額千分之二的的逾期違約金金，且設(shè)計(jì)人人提交設(shè)計(jì)文文件的時(shí)間順順延。逾期超超過30天以上時(shí)時(shí)，設(shè)計(jì)人有有權(quán)暫停履行行下階段工作作，并書面通通知發(fā)包人發(fā)包人的上上級(jí)或設(shè)計(jì)審審批部門對(duì)設(shè)設(shè)計(jì)文件不審審批或本合同同項(xiàng)目停緩建建，發(fā)包人均均應(yīng)支付應(yīng)付付的設(shè)計(jì)費(fèi)。9.1.6發(fā)包包人要求設(shè)計(jì)計(jì)人比合同規(guī)規(guī)定時(shí)間提前前交付設(shè)計(jì)文文件時(shí)，須征征得設(shè)計(jì)人同同意，不得嚴(yán)嚴(yán)重背離合理理設(shè)計(jì)周期，且且發(fā)包人應(yīng)支支付趕工費(fèi)。9.1.7發(fā)包包人應(yīng)為設(shè)計(jì)計(jì)人派駐現(xiàn)場(chǎng)場(chǎng)的工作人員員提供工作、生生活及交通等等方面的便利利條件及必要要的勞動(dòng)保護(hù)護(hù)裝備。9

34、cemennt of desiggn worrk, annd posstponee accoordinggly thhe timme of delivvery oof doccumentts.9.1.5 TThe Emplooyer shoulld pay chargges for desiggn to the Desiggner at the amounnt and date proviided in this Contrract. For each day of overddue paymeent, 2 of the overddue paymeent shalll be paid as

35、damagges for overddue paymeent and the time for delivvery by the Desiggner shalll be extennded accorrdinglly. Wheree the delayy of paymeent has exceeeded 30 days, the Desiggner shalll have the rightt to suspeend the perfoormancce of the work at the next stagee and give writtten noticce to the Emploo

In case the higheer authoority or compeetent deparrtmentt of desiggn approoval wouldd not approove the desiggn documments or the enginneerinng consttructiion of this contrract is suspeended or stoppped, the Emplooyer shoulld pay the payabble chargges for desiggn. 9.1.6 TThe emmployeer reqquests

37、s the desiggner sshouldd deliiver tthe deesign documments aheadd of tthe tiime sppecifiied byy the Contrract, it shhall nneed tthe appprovaal of the ddesignner, aand shhall nnot deeviatee gravvely ffrom tthe raationaal dessign pperiodd, andd the emplooyer sshall pay ffor thhe craashingg charrge.9.1.

38、7 TThe Emplooyer shoulld offerr conveeniencces in aspeccts of workiing, livinng and trafffic and necesssary laborr-prottectioon equippmentss. 9.1.8 TThe Emplooyer shalll be respoonsiblle for the natioonal standdard drawiing, minissteriaal standdard drawiing and locall standdard drawiings. 9.1.9 TThe

39、 Emmployeer shaall beear thhe exppensess for receiiving foreiign exxpert in chharge of thhe enggineerring tto thee Desiigners offfice (incluuding expennses oon faxx, tellephonne, coopy annd offfice aaffairrs).9.2設(shè)計(jì)人責(zé)責(zé)任9.2.1設(shè)計(jì)計(jì)人應(yīng)按國(guó)家家規(guī)定和合同同約定的技術(shù)術(shù)規(guī)范、標(biāo)準(zhǔn)準(zhǔn)進(jìn)行設(shè)計(jì)，按按本合同第六六條規(guī)定的內(nèi)內(nèi)容、時(shí)間及及份數(shù)向發(fā)包包人交付設(shè)計(jì)計(jì)文件（出出現(xiàn)9.11、9.

40、12、9.14、9.15、規(guī)定有關(guān)關(guān)交付設(shè)計(jì)文文件順延的情情況除外）并對(duì)提交的的設(shè)計(jì)文件的的質(zhì)量負(fù)責(zé)。9.2.2設(shè)計(jì)計(jì)合理使用年年限為25年。9.2.3負(fù)責(zé)責(zé)對(duì)外商的設(shè)設(shè)計(jì)資料進(jìn)行行審查，負(fù)責(zé)責(zé)該合同項(xiàng)目目的設(shè)計(jì)聯(lián)絡(luò)絡(luò)工作。9.2.4設(shè)計(jì)計(jì)人對(duì)設(shè)計(jì)文文件出現(xiàn)的遺遺漏或錯(cuò)誤負(fù)負(fù)責(zé)修改或補(bǔ)補(bǔ)充。由于設(shè)設(shè)計(jì)人設(shè)計(jì)錯(cuò)錯(cuò)誤造成工程程質(zhì)量事故損損失，設(shè)計(jì)人人除負(fù)責(zé)采取取補(bǔ)救措施外外，應(yīng)免收受受損失部分的的設(shè)計(jì)費(fèi)，并并根據(jù)損失程程度向發(fā)包人人支付賠償金金，賠償金數(shù)數(shù)額由雙方商商定為實(shí)際損損失的 。9.2.5由于于設(shè)計(jì)人原因因，延誤了設(shè)設(shè)計(jì)文件交付付時(shí)間，每延延誤一天，應(yīng)應(yīng)減收該項(xiàng)目目應(yīng)收設(shè)計(jì)費(fèi)費(fèi)的千分之二二

57、合引進(jìn)項(xiàng)項(xiàng)目的設(shè)計(jì)任任務(wù)，從詢價(jià)價(jià)、對(duì)外談判判、國(guó)內(nèi)外技技術(shù)考察直至至建成投產(chǎn)的的各個(gè)階段，應(yīng)應(yīng)吸收承擔(dān)有有關(guān)設(shè)計(jì)任務(wù)務(wù)的設(shè)計(jì)人員員參加。出國(guó)國(guó)費(fèi)用，除制制裝費(fèi)外，其其他費(fèi)用由發(fā)發(fā)包人支付。12.5發(fā)包人人委托設(shè)計(jì)人人承擔(dān)本合同同內(nèi)容以外的的工作服務(wù)，另另行簽訂協(xié)議議并支付費(fèi)用用。12.6由于不不可抗力因素素致使合同無無法履行時(shí)，雙雙方應(yīng)及時(shí)協(xié)協(xié)商解決。12.7本合同同雙方簽字蓋蓋章即生效。一一式貳份，發(fā)包人人壹份，設(shè)計(jì)人人壹份。12.8本合同同生效后，按按規(guī)定應(yīng)到項(xiàng)項(xiàng)目所在地省省級(jí)建設(shè)行政政主管部門規(guī)規(guī)定的審查部部門備案；雙雙方認(rèn)為必要要時(shí)，到工商商行政管理部部門鑒證。雙雙方履行完合合同規(guī)定
